Jailed gun dealer family hearing scheduled for this morning(NM)

A spokesperson for a gun dealer family jailed since last August for conducting alleged sales to straw purchasers has informed Gun Rights Examiner that a hearing involving all defendants is taking place this morning at the U.S. District Court in Las Cruces, N.M. Husband and wife Rick and Terri Reese were operating New Deal Shooting Sports in Deming along with sons Ryin and Remington when they were arrested for allegedly knowingly selling firearms and ammunition to Mexican cartel buyers.

“This is the most important hearing to date,” the source informed this correspondent via email. “All the lawyers have filed numerous motions, the most important is that the attorneys are asking that this entire case to be dismissed."

What’s clear from those is, the ability of this family to defend themselves—both in terms of seized assets meaning they have no resources, and court-ordered separate legal representation making a unified legal strategy expensive and difficult—has been tremendously complicated by the government. What’s also clear is they are being prosecuted by the same branch of government that won’t comply with subpoenas when its own role in allowing guns to fall into cartel hands is scrutinized. But because the government employees enjoy virtually unlimited resources along with administration and media support, none of them have been financially destroyed and are sitting behind bars waiting to hear their fate.

The war on some drugs has produced this outcome. Business people who have long been residents of the community can now be arrested, all assets siezed, and thrown in jail with no ability to make bond (all assets being seized) so as to be forced into a plea agreement.

This makes a mockery of the 5th and 8th amendments of the bill of rights.

Corrected for accuracy. His alleged crime is that he allegedly sold to the wrong straw buyers.

I’m sorry, but you would think by now everyone would know that selling weapons and ammunition to Mexican Drug cartels is strictly the job of the ATF.

People need to learn you never, ever talk to law enforcement without your attorney present. Ever. The minute Holder's ATF stepped in the door and started talking about Fast and Furious, these dealers should have said, "Let's schedule a meeting when my representation can be present to advise me."

If you don't do that, you're basically asking to be railroaded.

Selling guns to the cartel is a government monopoly according to the Obama administration.
