A special category of tuition created this month for illegal immigrants at a public university in Colorado violates both federal and state law, Judicial Watch points out in a letter to the schools Board of Trustees.
Therefore JW is calling for the immediate rescinding of the measure, which enables certain unlawfully present aliens to attend the taxpayer-funded school, Metropolitan State College of Denver, without having to pay full non-resident tuition. In approving this new category of tuition, the College recognized that these students would otherwise be required to pay full non-resident tuition because of their inability to demonstrate lawful presence in the United States, JW writes.
Because the new category violates both federal law and Colorado law and constitutes an act beyond the powers of the board, it must be reversed. Under federal law illegal immigrants are ineligible for state or local public benefits, including post-secondary education benefits unless a state enacts a measure affirmatively granting the perk.
Though a handful of statesincluding Texas, California, Utah, Washington and New York have done this, Colorado has not. In Texas and California the illegal alien discounted tuition measures have been legally challenged and at least three statesGeorgia, Oklahoma and Arizonahave solved the contentious issue by creating policies banning discounted tuition for illegal aliens at public colleges.
In this case one school passed the controversial measure, so it would apply only to that Denver campus, which has an enrollment of about 24,000. Founded in 1965, Metro State is a comprehensive college that offers both undergraduate and graduate degrees in a variety of fields. Its school of business, professional studies, academic affairs and science are considered to be highly regarded.
In announcing the new illegal immigrant tuition rate, the university issued a press release calling it a historical day that earned a standing ovation from students, faculty, community members and even state legislators. The Board of Trustees passed the measure, originally proposed by President Stephen Jordan, with a 7-1 vote after hearing testimony from an army of supporters, including undocumented students attending the college.
To qualify, candidates must graduate from a Colorado high school or obtain a general equivalency diploma (GED) in the state. Heres a good one; candidates must also provide a statement that they are in good legal standing, other than their undocumented or unclassified status. The goal, after all, is to help students living in the state of Colorado who through no fault of their own do not have the lawful status to be eligible for resident tuition rates.
Thats a classic line of the open borders movement, that American taxpayers are somehow responsible for helping illegal aliens brought the country as children through no fault of their own. Bottom line is that it violates a number of state and federal laws, though Metro Colleges president insists the Board of Trustees has the legislative authority to establish nonresident rates.
The DUmmies are pushing the MMJ issue to drive the Kos kids to vote in November.
Colorado vote on pot could affect Obama-Romney race.
At some point...there’s going to be a state which creates a chancellor of all public universities in the state....and start to conduct audits and regulation over campuses. There’s been a free reign system going on for decades. Between the pension systems, the special dealings of tuition rates, and unsafe conditions on campuses....it’s just begging for control by the state governor or legislature.
The college-bound illegals must have meet three criteria: attended a Colorado high school for the past three years. graduated from a Colorado high school or gotten a state GED. provide proof the illegal is in good legal standing, other than their undocumented status, and that they plan to seek lawful status when eligible.
The SEC, IRS and FBI will want to know whether Colorado is using proceeds from tax-exempt education bonds to subsidize people who are law breakers.
THIS COULD BE A PROBLEM Coloradans who voted for referendums on tax-exempt education bonds were not advised on ballots that their tax burdens were to subsidize law-breakers.
WRT their legal status----did the parents of any of these illegal students use their kids Social Ssecurity numbers to establish multiple identities in order to ride the US gravy train?
ICE's "documents and benefits fraud task force" found a common practice among "impoverished" illegals is to buy several faked identities for several thousand dollars each----the illegal then votes and rides the US gravy train under several names.
<><> Jose Madrigal---the Washington state rapist---had some 30 identities. And probably voted and collected US benefits under every single identity.
<><> Another illegal used multiple identites to bilk UI systems ofn some $3.5 million.
US Dept of the Treasury Says Illegal Aliens Collecting Billions in Tax Credits According to the US Dept of Treasurys Inspector General, more than $4.2 billion in additional child credits were paid out in 2010 to illegal immigrants. In 2005, the pay outs totaled $924 million. This program allows low income earners to claim a $1,000 per child credit. $20 billion EITC is estimated to have been paid out to these cunning "impoverished" illegals. Most of them are collecting over and over again-----using multiple identities-----falsifying official apps---claiming children they do not have and/or falsely stating kids are back in their homelands.
REFERENCE March 8, 2012 KENNER, La. -- Kenner police arrested illegal Marvin Baca who sold false W-2 forms to another illegal immigrant for $1,500. Baca sold fraudulent W-2 forms for $1,500 to other Hispanics here illegally.
Police said that on one of the forged W-2 forms had a SS no of a person living in Virginia. Police said illegal Hispanics purchase fictitious W-2 forms and file false tax returns with the government to receive EITC refunds. Baca was charged with one count of ID theft and two counts of forgery.
