BILL O'REILLY, HOST: And in the "Impact Segment" tonight a lawsuit filed against the Weather Channel. Nicole Mitchell worked there for nearly seven years forecasting the weather. But in 2010 her contract was not renewed.

Ms. Mitchell says that when the Weather Channel was sold in 2008 to NBC, the management began to question her status as a Captain in the Air Force Reserves. She believes her military position was a factor in her firing.

She joins us now from Burbank, California. How you can possibly prove that Captain?

She needs to contact John Odom in Shreveport, LA. Best USERRA lawyer out there. Retired Air Force Reserve JAG.

They cannot LEGALLY say that the contract wasn’t renewed due to her US Reserves status; however they can ‘manufacture’ practically any reason they like.

They don’t like her fashion sense, her shoes are too big, they are seeking to appeal to a demographic with a different hair style/color/length.

One of the ‘real’ problems with a job like hers, is that there are several times when she is obligated to serve; and the Weather show must go on. So, the station is going to manufacture a “Legal” reason to do this; unless they were foolish enough to send her an email complaining about her absence during Reserve Duty.

It looks like she has her ducks in a row with timelines and e-mails. I wouldn’t be surprised if the base JAG hadn’t given her advice on what would be needed if she had to file a suit.

YUM!

Military women are awesome. My cousin is former Air Force MP, and she’s hard as stone. I would not want to be engaged in a physical confrontation with her.

***the Weather Channel was sold in 2008 to NBC,***

And it has gone downhill ever since. NBC has tried to turn it into an Entertainment channel with some weather between shows.

What a honey. (The slightly off-color military jokes write themselves — I just deleted one!)

When they killed local weather and radar on *The 8's* for their attempted entertainment crap, that was it for me.

She certainly looks like a natural for Fox.

There are laws about terminating reservists and active duty military. There are specific procedures that must be followed.
I suspect she’ll win a settlement and then move on to her next career. Somebody is bound to hire her with that background.
