Native Americans to get millions after 'big victory' in Supreme Court

The Supreme Court has ruled that the government must fully reimburse Native American tribes for millions of dollars they spent on federal programs.

The federal government had agreed to fully reimburse money tribes spent on programs like law enforcement, environmental protection and agricultural assistance, but Congress capped the amount of money earmarked for that reimbursement. The tribes sued, and the 10th U.S. Circuit Court of Appeals in Denver said the money must be fully reimbursed.

The tribes sued, and the 10th U.S. Circuit Court of Appeals in Denver said the money must be fully reimbursed.

Sure!...What the hell?...It’s only taxpayer money!

If the feds were actually following Const. Art 1, Sect 8, the reimbursals, if any, would be limited to what the govt was doing, which would be limited. Just another consequence of the living and breathing constitution, unmoored from its foundings.

Looks like Thomas was the swing vote on this one.

These tribes operate like little turd-world countries. They squirrel and squander federal money, can’t find where all of it went, claim “it got lost”, then they beg, wheedle, whine and sue for more.

Interesting line up.

Seems to me we have a majority of the court on our side when it comes to rebating the $6 trillion debt Congress piled up taking Social Security money and peeing it away in measurements of cow flatulance (and such things).

Now that would happen if and only if somebody decided to shut down Social Security, but there you have it.

Actually, it hasn't been the tribes who said they have no idea where the money went, it's Interior Department that's been collecting royalties for mineral extraction for a 100 years that says it can't tell what they did with the funds.

This situation is one where the federales said they'd reimburse the tribes and then didn't.

the taxpayers have been giving the Tribes millions upon millions for many, many years. They should all be multimillionaires living in palaces by now.

Wow, that is a strange breakdown! 2 Libs 2 Conservatives 1 Moderate in the majority and 2 Libs 2 Conservatives in the minority. You don't see that very often!

next lawsuit --> U.S. government f'd up their online cigarette businesses when passing the law that no cigarettes could be sent through the U.S. mail.

the tribes will be sympathetic because Congress actually passed a law which interferred in commerce (their livelihood) (remember: Congress shall pass no law which interferes ... )

Driving past the sign on I-90 south of Buffalo, NY you pass a sign stating you’re entering the Seneca Nation (or whatever tribe it is). You’re somehow leaving the USA and State of NY as you pass the sign.

So... Perhaps we should treat it as a foreign country. Provide ZERO aid. NO votes in the US elections. Go through immigration/customs when passing the borders. Maybe require a passport.

I could care less. I don’t by cigarettes or hit up the Casinos.

Makes perfect sense to me, the tribes are supposed to be sovereign nations, so let them be sovereign nations for real.

40 percent of money from the federal government is borrowed to pay off the debt the other 60 percent comes from taxpayer cash.
Taxpayers will pay 60 percent of the money in cash and the rest is borrowed.

Why are we giving them any money anymore? They always claim sovereign nation status on their reservation land. Besides they make oodles of money on their casinos.

My ancestors let the US government lease some land from them a couple hundred years ago. To this day, I haven’t seen a dime nor have the deed. I’m not whining about it. This is much like slave reparations. Name one person alive today who was ever a slave... or their parents or grandparents.

They hide it pretty well save for the casinos. The graft goes off reservation our out of the area. The powers dribble enough trinkets off the edge of the tables to keep the natives quiet. An indian health clinic here an indian house there, a little road improvement etc. Just enough to keep it looking good.

In that Clarence Thomas voted to sustain this ruling, you are probably right on this one.

However, as a generalization, the tribal financial fiascos in this country are legendary. It amounts to a black hole where money goes and never sees the light of day.

I don’t want to get into treaty violations and other shenanigans from the past. It seems to me the reservations should have been divided up among tribal members 50 years ago, sold off, and allowed to become private property. The rezzes are just like little Gaza’s.

“The amount of money taken from the White Mountain Apache Tribe was well over a half million dollars,” said Investigator William Rucker. “When you talk about prosecuting … you’re talking about $750,000 when it’s all over.”
Rucker was discussing his investigation and upcoming fraud and/or embezzlement prosecutions of five or six people recently associated with the White Mountain Apache Housing Authority.

“The housing authority is here to help tribal members provide shelter for their families.
“It takes years on the waiting list. Now because of this many children will go without homes … maybe thousands!”
Rucker was outraged at the crimes he believes he has unearthed at the authority.

Similar story is a recurrent theme 4-5 times per year, going back as long as I can remember.

I have no use for the BIA or the Interior Dept, either. But Indian reservations suck.
