Issa Letter Hammers Obama on Operation 'Fast and Furious'
National Journal ^ | June 26, 2012 | By Major Garrett

---------- snip ---------- THE MONEY QUOTE

"Either you or your most senior advisers were involved in managing Operation Fast & Furious and the fallout from it...or, you are asserting a Presidential power that you know to be unjustified solely for the purpose of further obstructing a congressional investigation," Issa wrote. "To date, the White House has steadfastly maintained that it has not had any role in advising the Department with respect to the congressional investigation. The surprising assertion of executive privilege raised the question of whether that is still the case."

THE RETORT -------------

“The Congressman’s analysis has as much merit as his absurd contention that Operation Fast and Furious was created in order to promote gun control," said White House spokesman Eric Schultz. "Our position is consistent with Executive Branch legal precedent for the past three decades spanning Administrations of both parties, and dating back to President Reagan’s Department of Justice. The Courts have routinely considered deliberative process privilege claims and affirmed the right of the executive branch to invoke the privilege even when White House documents are not involved.”

“Misconduct occurred on two levels. Issa’s reference is to the false information submitted by DoJ officials in Congressional testimony, which is the specific subject of the subpoenas on which the contempt charge is based. However, the overall investigation into OF&F also probes official misconduct in deliberately allowing thousands of weapons to be carried over the border with no way to track them, which violates regulations at the ATF — which is why ATF insiders blew the whistle on the operation in the first place. Either way, Issa is entirely correct under US v Espy that deliberative process executive privilege does not survive in these circumstances.”

Issa to Obama: So … the White House is involved in Fast and Furious, then?

A read of the full letter reveals that Issa is concerned, in part, about retaliation against whistle blowers within the justice dept, part of the president's administration. It seems Senator Obama campaigned on a promise to support strong Whistle blower protection enhancements legislation, but once in orifice worked to defeat these initiatives by supporting a Demoncrat sponsored bill that weakened claimants' rights and protections. Guess which bill prevailed. Here is some background: Whistleblower Protection Enhancement Act

Now, why would President Obama be hostile to those who would call attention to corruption and illegalities within his government? Hmm.

Apply logic to our communists black Muslim King Obama and this purpose of Executive Privilege with F&F documents is for what purpose? Now can we suppose that it is to hide something King Obama does not want to see? Now I wonder????????????

“The Congressman’s analysis has as much merit as his absurd contention that Operation Fast and Furious was created in order to promote gun control," said White House spokesman Eric Schultz.

Oddly enough, this is absolutely true. As both the analysis and the contention are true and valid, they have equal merit.

Two of those firearms were discovered at the scene where Border Patrol agent Brian Terry was killed near Rio Rico, Az., on Dec. 14, 2010.

Three guns were recovered at the scene.

FBI Criminal Informant Complicit in Brian Terry’s Death (PJM Exclusive)

The rip crew was in Peck Canyon that evening with the intention of stealing money and drugs from a specific shipment of which they had prior knowledge.

(snip)

The rip crew knew to be in Peck Canyon that December evening because a CI working for the FBI found out about a smuggling run — from the FBI.

(snip)

The Drug Enforcement Administration (DEA) — through its own CIs and communications intercepts — was also aware of the planned assault.

Neither the DEA nor FBI warned Border Patrol about the expected criminal activity.

(snip)

The federal government will still not reveal if one of the two WASR-10 AK-pattern semi-automatic rifles located near the scene — provided to the Sinaloa cartel via Operation Fast and Furious — was the weapon that put a bullet through Brian Terry’s heart. The existence of a third recovered gun, an SKS carbine, has been disputed by the FBI despite the fact it had been talked about openly in the beginning of the investigation among federal agents.

Multiple sources tell PJM that this third weapon “disappeared” because it was the weapon carried by the FBI CI who ran the rip crew. When it was recovered near the scene of the murder and subsequently traced by the ATF, it traced back to the FBI CI via the gun shop in Texas where it was purchased.

Brian Terry’s murder was entirely preventable. The incompetence of the DEA and FBI let his Border Patrol unit walk into an ambush. After the ambush, it appears the FBI tampered with evidence to cover up that one of their informants was involved with the murder of a federal agent.

The Bush administration in its second term initiated the gun-walking program in an attempt to prosecute gun-runners and drug traffickers in Mexico. Under a larger program called Operation Gun Runner, an ill-fated program called Operation Wide Receiver was conducted from 2006-2007.

That statement is a bald-faced lie!

The Department of Justice ’ s Operation Fast and Furious: Accounts of ATF Agents

Agent Casa recounted a similar situation. He had also never heard of, nor seen, guns being allowed to walk until he got to Phoenix:

. . . . But from the time I started as an ATF special agent . . . up until the time I got to Phoenix, that was my understanding, that we do not let guns walk, absolutely, positively not. And if we –if ever a case [where]we would do that, there better be a really good explanation why we did not grab that gun when we could.

Q. But that changed when you came to Phoenix, I mean the practice at least changed, correct?

A. Yes.

(snip)

As Agent Dodson testified:

Q. Based on our training and experience, what did you think about [walking guns]?

A. It was something I had never done before, sir. And quite frankly, I took great issue with it and concern.I felt like I understand the importance of going after the bigger target, but there is a way to do that. We did it successfully in the dope world all the time. And those skills and practices that we used there, a lot of them transfer over, and more than applicable in gun trafficking investigations, but we weren’t allowed to use any of them.

Q. And did you ever have a recollection of sharing your frustration with Special Agent Casa?

A. Oh, yes, sir.

Q. And any other special agents that you can –

A. Yes, sir.

Q. And maybe you could just tell us what other agents you –

A. Pretty much everyone, sir. It was, I shared my reservations and concerns with Special Agent [L], with Dave Voth, with Special Agent [D]Special Agent [H], Special Agent Alt, Special Agent [P], several of the special agents that came on the GRIT, G-R-I-T. The gunrunner initiative is what it stands for. I shared them with or I voiced my concerns to other agents inside the Phoenix field division that was on other groups.

(snip)

Despite this e-mail, agents continued to experience dismay and frustration as Operation Fast and Furious continued along its perilous path. As Agent Casa testified:

Q. And is it fair to say that. . .the folks on your side of the schism wanted to do everything they could to interdict these weapons so they wouldn’t get any farther down the street than they have to?

A. Yes, sir. We were all sick to death when we realized that –when we realized what was going on or when we saw what was going on by the trends. We were all just, yes, we were all distraught.

The rift widened when the Assistant Special Agent in Charge (ASAC) authoritatively and unambiguously told Group VII that guns were not being walked, that the special agents were incorrect in their terminology, and that there would be no more discussion or dissension about this topic. Agent Dodson testified:

A. Then we get an e-mail that . . . there is going to be a meeting. [the ASAC] is coming down, [the ASAC] comes into the Group 7 office and tells us essentially we better stand down with our complaints, that we didn’t know what the definition of walking guns was, we weren’t familiar with the Phoenix way of doing things, that all of this was sanctioned and we just needed to essentially shut up and get in line. That’s not a quote, but that’s the feel of the meeting, so . . .

All four agents define "walking" guns as deliberately letting them go not losing control due to circumstances. All four say they never let guns "walk" before F&F. No guns ever "walked" under Wide Receiver. None!

In October 2009, the Obama administration expanded efforts to pursue high-level Mexican drug and arms traffickers. Building on Wide Receiver, efforts at the Bureau of Alcohol, Tobacco, Firearms and Explosives greatly expanded the use of surveillance of firearms purchases.

That statement may be technically correct but it is so misleading it qualifies as a lie too. How do you "expand efforts to pursue high-level Mexican drug and arms traffickers" when you let the guns purposely go? How can you call forcing gun shops to sell to unqualified straw buyers "expanded the use of surveillance of firearms purchases?" On top of that neither of those things were part of Wide Receiver. Major Garrett is turning out to be a fine establishment propagandist.

If Holder were not involved with this and wanted to find the bad guys it could be done in one week.

1. Ask the whistle blowers who ordered the guns to walk.
2. Ask that person whom ordered the guns to walk. If he refuses to reveal that information, indict and prosecute.
3. As the indicted person's boss the same thing and work up the food chain. Ask everyone in the chain the same questions, under oath. Repeat this process with the ATF and the State Department.

Those on the low end of the food chain get immunity for testimony. Those on the top end of the food chain get prosecuted.

This is what a honest department of Justice would do. Holder is in the food chain and above him on the food chain is Obama. If the White House was not involved, Obama would have Holder fired and prosecuted.

The Obama administration is Corrupt to Its Marxist Core.
