The Delaware Attorney General's office says nearly 1/3 of child abuse cases aren't able to be prosecuted because of current laws. Senate Bill 234 is meant to change that and help kids who are being hurt.
The bill redefines physical injury to a child, to mean any impairment of physical condition or pain. Senate Bill 234 has parents worried whether or not they can spank their children.
Mark Salerno is a stay-at-home father of three and he is against spanking.
"I don't believe in spanking your children, there's other ways to discipline them," he said. "I don't think physical pain should be endured on a child."
Salerno says young children can't understand the act of spanking, so to them it isn't a learning lesson. It is just pain.
But for Lupe Torsky, a little bit of pain helps her granddaughter behave when they're in the car together.
"I told her, 'You either stop or else I'll whip your butt,' and that's what I call it," she said. "A spanking is I'll whip your butt. So she didn't stop, she continued and I warned her. I pulled over to the side, I unbuckled her and spanked her."
Some parents want spanking written into Senate Bill 234 as exemption.
But Patricia Dailey-Lewis says the bill was never meant to target parents who responsibly discipline.
Wait until Mark Salerno’s kids hit 15 and don’t pay any attention to him at all.
They get pierced, ,smoke and do drugs and he will say: “I did the best I could with them, I never spanked them.
Mine got spanked when they needed it never harmed them inthe least.
Children are the property of the state. They demand to you how to raise them. You just get the privilege to pay for them.

But it will. And it will depend on Patricia Dailey-Lewis's (she the deputy Attorney General of Delaware) interpretation of what is "responsible discipline". She doesn't say and she can't, as the state will judge what that means on a case-by-case basis, so parents better be ready to face the full power of the state declaring them a child abuser: losing their children, jobs, jail time, labeled for life, etc, etc.
I'm sick and tired of lawmakers and government officials who don't consider all the consequences of laws they write and administer. They need to practice due diligence and word laws carefully to avoid over reach.
Well, that or they're just plain liars and they mean it to happen.
How about we pass a law that all laws must be reviewed by an independent board who investigate all the different ways laws can be misconstrued, misapplied, and changed? The board will have no power to change a law, just issue a public report on all of the ramifications. That way we'll know from the very beginning what the consequences are.

In today's climate of obesity hysteria, feeding your kid a donut could qualify as child abuse under this statute. So making them stand in a corner. "Impairment of physical condition" is one of those vague platitudes which have no real objective meaning and can make child abuse whatever anyone wants to call child abuse.

Spanking is against the law in Israel. But it’s not very strictly enforced. Really, there are better ways of disciplining children. My favorite is shoving them outside and locking the door until they ask politely to come back in and promise to behave. But it’s none of the government’s business one way or the other, and that’s why I can’t stand that law.
However when your children grow older and refuse to listen to the police when told to pull their cars over they will
be beaten with clubs and fists.
The government, in particular Child Protective Services, equates ALL correction/training/discipline of children as “abuse.” CPS is merely the tool of the vindictive custodial (usually) ex-spouse to get back at (usually) non-custodial ex-spouse for attempting to discipline the child(ren) involved while in (usually) his care.
Pursuing REAL child abuse is politically incorrect (most minorities believe in BEATING their children and severe forms of punishment long abandoned in caucasian neighborhoods) AND is far too DANGEROUS for the average CPS worker. The average CPS worker is one of those “single moms” who has a natural vendetta against fathers in general and subscribes to “just let Junior run wild but put him on meds and be his best friend.” I know b/c my hubby’s ex-wife is one.
Instead of discipline/correction/training, the average “single mom” puts Junior on health endangering, mind bending DRUGS!! You can’t tell me there isn’t kickbacks in all this gov’t legislation to the Psychologist and Pharmaceutical industry.
Putting children to bed at a decent, consistent hour, limiting electronics and brain pablum such as “Spongebob”; feeding children a healthy diet with an occasional treat (not dessert at every meal) and fresh air/exercise is all considered “abusive” to children nowadays.
Children end up “free ranged”, narcissistic, entitled with zero respect for ANY authority (see Obama who was PITIED for being a mixed child with a single mom not PARENTED) Low to no expectations, failure at school due to a “low tolerance for frustration” due to being coddled, pampered and pandered to is the NORM nowadays.
Perhaps you’ve seen the oversized child squeezed into the shopping cart “toddler seat” shrieking repeatedly at the top of his/her lungs while his twenty something (usually) single mom just ignores it as though deaf and never bothers to correct said child by saying “cut it out” or “quiet or I’ll take you back to the car.”
The most violent, nasty, rotten tempered children I’ve seen are the ones who aren’t spanked; usually because the parent fails to discipline at all, neither in word nor deed. The “popular” non-parenting model today is to be your kid’s BFF.

This is for a good reason.
And it is exactly why the left seeks to undermine it.

A couple of things here... first, the hyphenated name is a dead giveaway.
Second, this shows the worldview of a leftist - they believe that these things should be left open to interpretation, and would never, never, be abused by any government representative to undermine parental rights. Why, after all, only the best and brightest work for the government.
And the recruiters wonder, when they call my husband, why he refuses to look at jobs in the Northeast... stupid liberal busybodies.
