Though, I think I got most of the grief out of my system by now... it was when I was told by a SFC to "shut up, private" when remarking, after the `08 election and before inauguration, when I stated that if Obama was not qualified it was the Army's duty, via their oath to the Constitution, to oust him. It was at that point that I realized, really realized, how worthless an "oath" really is. got out when the enlistment expired and haven't looked back.

The Constitution is meaningless if there is no penalty for violating it.

I agree. It’s being spun as a win, but in fact most of the main portions of the act were overturned.

About the only thing that survived was Congresses power to tax.

I think they framed ot that way in order to allow the tyrant Hussein to more easily use the full force of the IRS to enforce payment of the mandate. The IRS will be used as never before (and it’s already bad) to bully ctizens.

Also please remember Justice Alito and Justice Roberts got also got in under him and his Dad! Did they go left in this decision? Huh? No, they didn’t, did they?

Dude, our political view in limited government (et.al.) is completely wrapped by the python and about to let out its last breath. Even if we win in November, nothing changes. A SC that just made a decision based on nothing but wishful thinking will stay in place. A new govt. will be lead by someone who enacted this same thing in his state. The people elected are too damn afraid of what the media and the left says about them, so they’ll end up compromising — we’ll end up just short of what we have today.

I’m playing a rigged game. My opponents have no reason to stop lying, no reason to stop name calling, no reason to stop enriching themselves at my expense because they have more than a sufficient number of idiots who will go along with anything they propose. I can’t play a game where I have to lie and cheat and its impossible to win at that game when your opponents do nothing but that. And we are LONG past any reasonable likelihood that this will change, even IF we could elect people that could stand firm to original constitutional principles.

THE GAME IS OVER. If you want to keep playing, fine. But I’m done. This country is much, much worse off than it was when I became politically active — after me getting almost nothing of what I wanted. UNTIL YOU OR ANYONE ELSE ON HERE COMES UP WITH A WINNABLE STRATEGY, THERE IS NO POINT IN FIGHTING AND GETTING YOUR ASS KICKED 100% OF THE TIME.

I have given a winnable strategy before, but few even on this site are willing to go along with it. It includes at least ALL of the following:

— term limits for ALL elected officials;
— stopping all newspaper subscriptions except those 100% committed to conservative causes (zero that I know about);
— turning off ALL forms of popular culture on TV and internet — stop watching morning shows, evening news, all cable news other than SOME Fox, stop watching Letterman, SNL, etc., stop going to movies, stop buying CDs and downloading PC music;
— ALWAYS vote for the most conservative candidate regardless of individual views;
— stop giving money to institutions that have failed us (Republican party) and start supporting those conservative causes that have worked (numerous, but NRA is one example)
— stop arguing with the left and start ridiculing them

There are others I can’t think of at this point, but I seriously doubt I could get even 25% of FR members to sign on to ALL these ideas.

There was a leak but the leak in itself is not critical to the issue. The decision and its ramifications to personal freedom and how we feel the Constitution should be interpreted is the crux of the matter.

IMHO, the law will not be repealed even if the GOP takes the WH and Congress. Too much money and power is at stake for our elected leaders to do the right thing. A so called simplification to single payor is what I feel will eventually happen.

If there is to be a “coming struggle”, the “pro-federals” can easily crush the “pro-freedoms” by virtue of their superior military and police (think SWAT teams gone wild) powers, plus the overwhelming advantage the pro-feds have by virtue of the extraordinary technological advantages they possess.

I’d like to see a modern-day DC equivalent of “The Battle of Athens” (look that up on YouTube), but realistically, I don’t see that happening for the pro-freedoms, at least not with the same results.

However, Lazamataz’ second assertion may be much more viable. To put it another way, if enough pro-freedoms concentrated themselves into certain territories, it might prove less destructive for the pro-federals to agree to some kind of “parting of the ways” than to face the consequences of crushing the freedom-lovers out of existence. Why not a “Commonwealth of North American States”?

Aside:
It’s well-know how the ‘rats and the Obama administration have granted “waivers” to certain organizations (labor), and even entire states (wasn’t Nebraska exempted in some way in exchange for Ben Nelson’s vote?) to “opt out” of ObamaCare.

If Romney gets elected (uncertain at this point, and today’s decision doesn’t help), HE (through his administration) will then be able to grant waivers. Why not just offers states the option, on a statewide basis, to simply “opt out” of ObamaCare?

Those that want to stay with it, can do so.
Those that want to be left out, can do so.

And then we’ll see what works, and what doesn’t.

Based on the unanimous ruling on the one area if the Immigration ruling I thought it would be unanimous that it was unconstitutional per the Commerce Clause and IT WAS

This is one serious snakepit. I’m still reading the 11th Circuits opinion.

As far as I can tell, this is what happened:

Plaintiffs went in front of the 11th circuit court and claimed ACA was unconstitutional on two parts:
The Medicaid expansion
The individual mandate.(based on the commerce clause)

11th Circuit issued its findings:
Medicaid expansion was OK
Individual mandate was not ok(based on the commerce clause)

Government appealed to the USSC

Argued again the the medicaid expansion was OK.
Argued that the mandate was OK under the commerce clause, but additionally argued that it was OK under the taxing power.

USSC issues it’s decision

Throws out Medicaid expansion by making it optional for the states
Agrees that the individual mandate FAILS under the commerce clause
But in a new argument THAT NEVER WAS PART OF THE 11th Circuits case, finds that the individual mandate is proper under Congresses taxing power.

The Supreme Court today basically kicked the can down the road.

Like I said, it’s a snakepit and may take years to sort out, but there is NO WAY it can be said Obamacare was upheld, at least not in toto in the form it existed when passed by Congress.
