I’m Not Down on John Roberts

. . . I get the strong sense from a few anecdotal stories about Roberts over the past few months and the way he has written this opinion that he very, very much was concerned about keeping the Supreme Court above the partisan fray and damaging the reputation of the Court long term. . . .

Second, in writing his case, Roberts forces everyone to deal with the issue as a political, not a legal issue. . . Third, while Roberts has expanded the taxation power, which I don’t really think is a massive expansion from what it was, Roberts has curtailed the commerce clause as an avenue for Congressional overreach.

Well, not really. The idea of “on to Congressional repeal!” would be fine, except that we now live in the era of everything-must-pass-the-Senate-with-60-votes.

And the GOP isn’t going to get 60 votes in 2012.

Even if they get it in 2014, that will be too late.

Yes, Roberts saved his reputation among his law school faculty buddies. They will sing his praises for his “courage”

But the country has been altered, again, and most likely there is no going back.

Dammit. I feel sick to my stomach today.

You’re right, Jedidah. Erickson’s piece IS a voice of reason today. BTW, he apparently actually took time to READ the opinion, unlike most of the kneejerk flamers.

This is an interesting article, but I think his point here...:

...is wrong. It's a pretty massive expansion.

“Those decisions are entrusted to our Nation’s elected leaders, who can be thrown out of office if the people disagree with them. It is not our job to protect the people from the consequences of their political choices.”

Time to get out from behind the computers and get to work...Just like our forefathers we throw the government out. In our case it's through election and not with guns. Donate, register neighbors, pass out fliers, get involved. We need sixty senators, a Real leader as President and the House.

Violating the Constitution because of political fears is not a reasonable response.

Does anyone think that Obama won’t appoint an even worse Communist to the court next chance he gets?

Or that Bishop Romney won’t also appoint another extreme leftist to the court, as he did while governor of Massachusetts?

Not fighting back only encourages these traitors.

Well, for those that think in real world, functional terms he has done EXACTLY that-damaged the reputation of the Supreme Court.

But I guess he is only concerned about the opinion of useless academics, and legal historians...

If Mr Romney wins in November I would be pleased to see him repeal this bill, and then require every household to purchase firearms. Those that do not comply will be hit with a tax (not a mandate)for non compliance.

No, the role of the Supreme Court is to be a check on Congress. Just because Congress passes a law doesn't make it constitutional. The Supreme Court has overturned congressional acts many times.

A voice of ignorance. Roberts in his finding has with the other justices on the left has, in a single decision, permanently damaged the personal liberties and freedoms our Constitution was set up to protect.

No matter what happens with legislative reversal, the precedent has been set in law--the federal government now has the right--under the Constitution (according to these evil, evil, freedom-hating "justices") to require compliance on virtually any issue by instituting taxes to force said compliance.

Redstate is wearing rose-colored glasses and excusing the inexcusable.

The America that our Founding Fathers left us is now officially DEAD.
