Jack Lew: The individual mandate isn't a tax

Never mind what the Supreme Court said — the White House is doubling down on its insistence that the individual mandate isn’t a tax.

Speaking on CNN’s “State of the Union” Sunday morning, White House Chief of Staff Jack Lew said the mandate penalty is not a tax and the Supreme Court ruling didn’t make it so. And in any event, he said, very few people will have to pay it.

“First of all, the law is clear, it’s called a penalty. Second of all, what the Supreme Court ruled is that the law is constitutional. Actually, they didn’t call it a tax. They said it was using the power under the constitution that permits it. It was not labeled,” Lew said.

“This is a penalty. It’s something that only 1 percent of people who can afford insurance and choose not to get it will pay. Everyone who has insurance, everyone who chooses to buy insurance will not pay it. That’s a good thing for the American people.”

In the commercial break that followed the exchange, an ad paid for by Americans for Prosperity called the Obama health care law “one of the biggest tax increases in history.”

We can’t let the Dems off the hook. They crammed ObamaTax Health Control down our throats by lying and more lying and still lying. They used the ‘tax’ argument before the Supreme Court ... we need to remind the Lews of this world about that every time they say “it’s not a tax, it’s a penalty”. Then why in h.e.dbl hockeysticks did you defend it as a TAX?

“It’s a TAX” needs to be reciprocally crammed down their throats at every single opportunity .... and we need to make a lot of opportunities.

For the president to go on record that this is a fee..after the supreme court has ruled specifically that it’s a tax; could this not be ruled contempt of court, or to make the decision voidable?

More misrepresentation. What the Court ruled is that the law can not be ruled unconstitutional based on the specific challenges launched in this case, not that it is constitutional based on the entire Constitution. Second, the court did specifically call ObamaCare's mandate a tax - numerous times - saying that it is only Constitutional under the power to tax. When Obama gets tired of lying, he sends his minions out to lie for him. Liberals disgust me.

This is quite possibly one of the most brilliant things ever, and I do mean ever, said about Obamacareless. It wasn’t said by a talking head. It wasn’t said by some politician misery-pimping for another term-—this was said by an everyday citizen. There is no purer form of wisdom. The fat, bloated pigs in the federal government make laws that they don’t have to live by and therefore have no clue.

The Dems/Team Obama strategy is to muddle things.

As Britt Hume said on FNS, they are trying as hard as they can to keep from calling Obamacare a ‘tax’; they are running from that.

McConnell claimed that all 60 Dem senators who voted FOR Obamacare were voting for a TAX.

Since SCJ Roberts basically called Obamacare a tax, the Dems are having difficulty — recall Obama’s claim that Obamacare would not add one ‘dime’ of taxes to the middle class?

[Hmmm.... this ruling may turn out to be Obama’s ‘read my lips, no new taxes’ albatross.]

Just looked up Jack Lew on Wikipedia. He is a Harvard graduate as well a Georgetown U. He has been in govt. his whole life. And, from the statements that I heard on Fox, he is a 'flaming liberal/progressive'.

It is my humble opinion that liberal/progressives are bred and incubated like chickens in these institutions.

Some will flame be like a burned steak for these statement, but I stand by them.

Please note that this statement does not explicitly refer to the richest Americans. "People who can afford insurance" refers only to those who the government says can afford it but do not buy it. We are offered health insurance through my wife's employer, but it is very expensive. With our income, we would not have enough left over after paying for health insurance to pay our modest bills.

I am absolutely confident the quoted statement is referring to people like us. The gub'mint will crunch their numbers, tell us that we can "afford" what's offered, without regard to our other bills (housing, food, utilities, clothes!), and we will get hammered.

Why is the concept of the individual mandate being both a penalty and a tax so hard to grasp?

This is just Jacob Lew out there trying to limit the damage to his cause by sowing confusion on the Roberts ruling that said the individual mandate is for some purposes a penalty AND for other purposes a tax.

Roberts has said it is a tax, and that recognition may help repeal this Tax Bill, and Jacob Lew does not want that, and Lew is not under oath so he is working with CNN to spin it his way, and spinning is intended to cause confusion.

It doesn't matter. If you repeat a lie often enough it becomes the truth. Those who get their news from the mainstream media will quickly be repeating the lie to themselves: "It's NOT a tax!"

The Democrats must prevent the law from being considered a tax.

If it’s a tax, they can’t grant waivers and the bill can be overturned via reconciliation.

They, along with their allies in the MSM, will fight this tooth and nail.

I have pointed out in several posts that Carney and the Dems repeating the “not a tax’ crap are quite literally acting under color of authority.

A cop that gives you advice/makes statements that is/are contrary to the law can be and often is sued along with their dept. for doing so ‘under color of authority. It is a crime.

One track the GOP and others should take is to file suit for the same reasons. At minimum, push the meme.

your premis is on point My idea revolves around the fact that Obama denies it is a Tax. Just because SCOTUS calls it a Tax would change the rules and the way it is treated. I believe Congress has that right. Can’t they change it now?
BHO has no say in how Taxes are collected and distributed. Where are the Conservative “Legal Eagles” on this?

Someone or Somebody needs to remind Jackass Lew that the Obama US SCOTUS attorneys argued from the position that ObamaCare was indeed a tax, that SCOTUS deemed it a tax, and that the Repubs can get rid of the mandate with 51 votes as it is a tax that falls under budget provisions. =.=

The trick is that as the number of mandated items that must be covered by insurance grows, the number of folks who can afford insurance will drop. Insurance coverage of pre-existing conditions will drive costs through the roof.

I do have to admire the way this was weasel-worded. It boils down to 'if you can afford insurance, you will buy it'. Which is generally true until you get rich enough to just pay cash. But we won't be able to afford the insurance.

I don’t argue with the fools. The only person I have 100% control over is myself. So, I will do what I have to do ... and will try to encourage other like-minded folks to do the same. Surrender is not an option for me.

A silly story ... a friend of mine’s grandmother was a Southern Lady, wife of a judge, lots of social standing, etc. Back in the day, women wore bloomers for underwear ... held up by elastic run through a casing in the top of the bloomers. She was walking down Main Street one day, pretty much in front of the whole town. The elastic in her bloomers suddenly broke and they fell around her ankles. She never missed a beat ... never looked down, no cries of horror or embarrassment, no trying to repair what was unfixable at that moment. She kept her head high, stepped out of her bloomers & kept on trucking.

I’m stepping out of the “bloomers” that fell around the country’s ankles on Thursday & I’m trucking on.

That is not the end of the matter. Because the Commerce Clause does not support the individual mandate, it is necessary to turn to the Government’s second argument: that the mandate may be upheld as within Congress’s enumerated power to “lay and collect Taxes.”

The Government (read Obama and his Socialist cronies) wanted it to be called a tax if it didn't pass muster on the Commerce Clause issue!

These guys are still trying to lie their way through this.

How do we know this for certain?

Simple. The Supreme Court done told us it was a tax. Moreover, the only way Obamacare could have been constitutional, said the SC, was if this assessment was a tax.

Sorry, Mr. Lew. You get to defend this massive tax increase during the election season. Hope you're up to it. ;-)
