Republicans to press "Fast and Furious" suit
WASHINGTON | Sun Jul 1, 2012 1:11pm EDT

WASHINGTON (Reuters) - The Republican-led U.S. House of Representatives plans to file a civil suit in federal court in the next several weeks over the Obama administration's refusal to give Congress documents about a failed gun-running probe, House Speaker John Boehner said on Sunday.

The Justice Department said on Friday it would not prosecute Attorney General Eric Holder after he was cited a day earlier by the Republican-led House for contempt of Congress for withholding some documents related to the probe. Holder heads the department.

"We are also going to file in District Court a civil suit over the issue of executive privilege," Boehner told the CBS program "Face the Nation."

"I would expect that to be coming in the next several weeks, but it needs to happen," Boehner said.

The lawsuit could lead to a prolonged court fight while a judge weighs the House demand against the Obama administration's claim of executive privilege to protect the documents.

Nothing big happens at least until after the election and if it gets dicey then, Obama will pardon Holder.

This will take forever. It will get dragged out, and go all the way to the Supreme Court, where Roberts will have another brainstorm.

Can congress impeach Holder? Or refuse to fund the Justice Department as long as he heads it? Or SOMETHING?

Why does it take the gonadless party forever to do anything? Several weeks? How 'bout next week. Oh, yeah, July 4th. Okay, the next week? Oh, not in session? Then STAY in session to get this done! IMHO, this is much more important than worldwide junkets, BSing your constitutents, etc.

If the DEMS can judge shop, so can the GOP.

Yeah like the comment insinuating it's a waste of time pursuing and doesn't warrant the effort of Congress, however no comment about the dead border agent or our executive government running a sting with arms across the border and withholding all information from Congress.

Congress no longer has a jail so they should contact Joe Arpaio and arrange for space in one if his tents and a pair of pink under ware!

This one won’t be the fault of the GOP. The Court system’s on a planet all its own, and would probably make the “fog” opening of Bleak House a clear, sunny day at the beach.

You are correct - I expect Obama to give Holder a pardon all filled out and signed for him to use as a GET OUT OF JAIL card.

The GOP also needs to name as many of Holder's underlings that are lying for him as well, Obama cant pardon all of them. Shake them up, we might get more whistle blowers with more evidence.

There are 3 options

1. Criminal contempt of which the District Attorney is charged with pursuing this. He refused!

2. Civil contempt which would be taken up in a civil court and Congress is going to pursue this.

3. Arrest by congress which it just may end up happening! If Boehner gets enough pressure from his colleagues.

Rep. Jason Chaffetz (R-Utah) on Friday raised the possibility that Attorney General Eric Holder could be placed under arrest now that he has been found in contempt of Congress.

“I find it hard and dramatic to do, but look we want to get to the bottom of this. We’re serious about this. I don’t think the Democrats thought we were serious to actually hold him in contempt, but this is a serious enough case,” said Chaffetz on Fox News.

Chaffetz, a member of the House Judiciary Committee, told Fox News that there are three options moving forward — going through the U.S. attorney, taking civil action or instructing the House sergeant at arms to “take control of the situation” with an arrest.

However, he acknowledged the House had received a letter from Department of Justice instructing the U.S. attorney for the District of Columbia to not pursue legal action.

The Utah congressman predicted that some people will call for Holder’s arrest, but said the House would “try to exhaust” its other options first.

“The federal government purposely and knowingly gave the drug cartels 2,000 weapons, mostly AK-47s, and we’re just supposed to walk away an not pursue this. That’s just not going to happen,” he added.

The House voted Thursday 255-67 to place Holder in contempt of Congress for failing to comply with a subpoena for documents related to the botched “Fast and Furious” gun-tracking operation, in a dramatic session that prompted least 80 Democrats to hold a walkout.

Chaffetz called the Democratic protest, “silly” and “nonproductive.”

“Have the debate, all we’re asking for is the documents. If there’s nothing to hide, show is the documents,” said Chaffetz.

The unprecedented vote prompted Democrats to blast the proceedings as politically motivated and an “abuse of power.”

Holder said, in a press briefing Thursday, that Republicans and Rep. Darrell Issa (R-Calif.), chairman of the House Oversight Committee, were focusing on politics rather than public safety.

“I had hoped that Congressional leaders would be good-faith partners in this work. Some have. Others, however, have devoted their time and attention to making reckless charges,” said Holder.
