Levin is not a Justice, Supreme Court or otherwise. He can’t enforce anything. Furthermore, he doesn’t like wasting time where time would be wasted. Unfortunately, the eligibility issue is a time waster.

Re the 20th Amendment, Section 3, Biden could be Acting President. Good luck with that.
