Aide: Romney sees mandate as a penalty, not a tax

WASHINGTON (AP) - A top adviser says Republican presidential candidate Mitt Romney doesn't see the health care mandate as a tax but as a penalty or a fee or even a fine.

That's a different view from Republicans who are condemning the individual mandate in President Barack Obama's health care law as a tax instead of a penalty, as Obama prefers to call it.

Romney is right, it is a penalty. It is not a tax. I’m sorry to see Allen West and scores of other Conservatives calling it a tax just to score political points for the coming election. I understand their motivation, but the fact of the matter is that if I buy a kitten and call it a cow, it doesn’t make it bovine.

The penalty in Obamacare is certainly not a tax. Roberts just made that up, knowing there is no higher court in the land to which we can appeal the ruling. The Chief Justice of the nations highest court can just pull stuff out of his ass, knowing that he gets the last word. If he says the sky is blue instead of purple, then the color we all see as blue is sudden labelled purple.

I have nothing but contempt and scorn for Benedict Roberts.

The odds of Obamacare repeal is not in our favor. McConnell sucks but he is right. Unless or until both the White House and Senate become GOP controlled, then there is no chance of repeal. With Obama in the WH and with Reed running the Senate, McConnell is right to say there is scant chance of repeal. Now after Jan. 1, 2013 when we have the WH and Senate and keep the House, then there will be repeal.

McConnell isn’t a conservative first of all, he is a Republican - a weak establishment one at the least and the way he was talking wasn’t about counting chickens - any conservative who follow politics should automatically side on it NOT being repeal with these feckless bunch of Republican leaders we have to seem to tough talk but weasel out in the end

What are the odds you offer on electing enough Republicans to have a total of 60 Republican US Senators?

Unless that number is very high, then I’m voting Romney and hunkering down.

And that’s assuming none of the 60 would be RINOs. I’d think the resulting odds would be very very long indeed.

A sumptuary tax is a tax, like any other tax, but it's designed to suppress the use of a substance, or a mode of dress. We pass them all the time on alcohol, drugs, tobacco etc. and call them excise taxes.

The classical term, sumptuary, is not used much these days since most folks call them by a different name but you'd recognize the term "sin tax".

Obviously any excise tax that has as its objective the reduction in consumption of any commodity is actually a 'sumptuary tax'.

I have my own theory about why Roberts came to the realization the "penalty" was actually a tax, but it can be neatly hedged in with two terms ~ excise and sumptuary.

Nothing new there.

Now, about Nancy Pelosi's involvement in this. She has been bellyaching for ever and a day about the people she has called "leaches" or "free riders'. She wants to eliminate that behavior with a penalty of some kind ~ a TAX even ~ that will result in less consumption of a certain commodity ~ to wit, unpaid medical care.

The Democrats tried to hide this from everyone by calling it anything but a tax. Internal to the obamaKKKare legislation is another sumptuary tax ~ this is the one on companies who offer medical insurance plans that are TOO SUMPTUOUS.

Yup, there you have it ~another sumptuary tax, and thee are more ~ those on new medical technology for example ~ they don't want scientists putting on airs by developing brave new medicines that defeat disease.

Another term you need to know about is BLUE NOSE. Nancy Pelosi and obama are both humorless BLUE NOSES ~ they don't want anyone to be happy, or to have a favorable outcome.

Sarah was right, these Leftists want us to pay too much, suffer, and die.

The Individual Mandate is a tax. The bill is filled to the brim with other taxes.

It can be handled under existing Senate rules on the same basis as any other revenue measure ~ and 51 votes wins!

The problem here is that semantically, Romney is correct. And Justice Kennedy’s dissenting opinion makes a strong and compelling case that he’s correct legally, too.

However, the Roberts majority opinion says it’s a tax, at least as a matter of Constitutional law. And since that’s the only reason the law stands, the mandate must not be treated as anything other that a tax for political purposes, too.

I suggest we conservatives forever refer to this case ‘Roberts vs. The Constitution.’ He wanted a legacy. We’ll give him one.

The GOP lost its backbone when Lee Atwater died. Unlike the DNC which does not care one whit about the facts (or anything else), the GOP repeatedly fails to strategize and communicate a simple campaign message!
