(Lance)Armstrong suit to block doping charges dismissed

AUSTIN, Texas (AP) — A federal judge has dismissed Lance Armstrong's lawsuit against the U.S. Anti-Doping Agency, but says the cyclist can refile it within 20 days.

The seven-time Tour de France champion sued USADA on Monday in an attempt to prevent it from moving forward with charges that he used performance-enhancing drugs throughout much of his career.

U.S. District Judge Sam Sparks ruled just hours later. He criticized Armstrong's attorneys for filing an 80-page complaint the judge says seems more intended to whip up public opinion for his case than focus on the legal argument.

Sparks, however, did not decide on the merits of Armstrong's case and said he can refile his lawsuit.

Armstrong wanted Sparks to rule in his favor by Saturday, the deadline he faces to either accept sanctions from USADA or go to arbitration.

Lance Armstrong is a big hypocrite. I know some on FR will villify me, but he was big backer of Prop. 29 in California which would have raised cigarette taxes by $1 per pack.

He is another Bloomberg, IMO.

If they can “prove” Lance was an expert at hiding doping, where will that leave Major League Baseball?

Are they going to charge Jeter with doping. Not that they found any, but because he can dope and hide it?

Agree. Every sport is dirty, male / female, pros all the way below jr. high now. And that includes golf! None of it worth watching; it's a bunch of knotheads hopped up on ‘roids, HGH, EPO, blood doping, etc. Go outside for a walk / jog / run or to the gym for some strength training.

No, I will not find your posting less valuable because of the sometime stupid behavior of one of cycling's most efficient racers. I agree with you. Lance Armstrong does some damn stupid shit. So What! Don't we all. So he is a jerk too! That jerk, has done some amazing stuff. Don't be so sanctimonious with your dismissal of his accomplishments, including his Livestrong foundation. Lance for all his faults is a damned accomplished human being. HE has talent to be sure, but he also has drive.

Tell me where you can buy that in a bottle with a syringe. Thought so! you can't Lance with one testicle has more balls than half the men in the US of Pussy. This guy is not on Wall Street or in D.C. shoving some F'd up health plan up our asses or installing red light cameras or droning some toy to snap pictures of us, NO this guy suffered in bouts of competition that most of the readers of FR can not even begin to imagine.

And now some punk ass USADA wants to strip him because they say they can. Because it is only sport. Go ahead USADA. Your shortsighted vision is only exceeded by your egotistical craving for the recognition of your pathetical day late and dollar short organization! GOOD LUCK!!

Your knight in shining armor {Armstrong} is a pig, as he dumped his wife & kids for Sheryl Crow then dumped Sheryl when she got breast cancer! A Real Pig!

Armstrong is like Mayor Bloomberg of NYC they act high & mighty & self-important!

Maybe Armstrong’s attorneys need to review FRCP 8 and focus on the word “short”.

RULE 8. GENERAL RULES OF PLEADING

(a) Claim for Relief. A pleading that states a claim for relief must contain:

(1) a short and plain statement of the grounds for the court’s jurisdiction, unless the court already has jurisdiction and the claim needs no new jurisdictional support;

(2) a short and plain statement of the claim showing that the pleader is entitled to relief; and

(3) a demand for the relief sought, which may include relief in the alternative or different types of relief.

Should be able to state a claim in 10 pages or less.

I have no sympathy for Sheryl Crow. A woman who is screwing a married man, has no room to complain when she gets dumped; for any reason.

BTW, Armstrong is an a-hole for a number of reasons. That said, this doping group is going to get hammered in a law suit when it gets to that point.

I don't follow many sports, but I do know of Lance Armstong.
A legend in his field, and a man who was accused of doping for years by foreign countries, mostly France.
The decades of accusations were all either disproved and or dropped, to the best of my very limited knowledge.

Regarding this case: It doesn't matter if he backed a tax I do not agree with. It doesn't matter if he dumped his wife to date a woman I don't approve of, and then dumped her. It doesn't even matter what percentage of people think he is a jerk.

What I find odd and jarring is that a “judge” just dismissed an 80 page long counter-suit to stop the persecution...just because he felt like it...instead of ruling on the merits of his case.
