Man (Colombian) enters guilty plea for attempted abduction in Roanoke

The plea agreement drops robbery and battery charges against the man, who was to be released.

A man who grabbed a stranger in downtown Roanoke in March pleaded guilty Thursday to attempted abduction.

Mauricio Ramirez-Diaz, 22, initially had been charged with assault and battery and attempted robbery, but in June a Roanoke grand jury added abduction with attempt to defile and misdemeanor sexual battery to the counts against him. Through a plea agreement, prosecutors dismissed the robbery and battery charges and amended the abduction charge to a lesser felony.

Ramirez-Diaz, who had been held since March, was given a two-year sentence, suspended, with credit for time served and was slated to be released from jail.

Assistant Commonwealth's Attorney John McNeil told Judge Jonathan Apgar the female victim was walking to work the morning of March 1, on Salem Avenue near the Virginia Transportation Museum, when Ramirez-Diaz came up behind her and wrapped his arms around her.

McNeil said the woman, who did not know the man, told police she wriggled free after a few seconds and Ramirez-Diaz followed her, shouting inappropriate statements. He followed the woman into her workplace, was turned away by security and was later arrested on Norfolk Avenue, McNeil said.

"It became clear to us he wasn't trying to rob her," said Roanoke prosecutor Joshua Dietz. "Our concern was that it was some sort of abduction and assault. He was charged with sexual battery because of some of the comments he made."

Ramirez-Diaz, who is from Colombia, said during the hearing that he has a passport and is in the process of getting a green card.

According to online court records, he was given a competency examination in May. During Thursday's hearing, he spoke through an interpreter.

Although he was due to be released from the Roanoke City Jail after his hearing, it was unclear Thursday whether that had occurred, and U.S. Immigration and Customs Enforcement spokeswoman Danielle Bennett said a new detainer had been placed on him at the beginning of the week.

"A convicted felon would fall under ICE's priorities," she said.

According to Roanoke General District Court records, Ramirez-Diaz at the time of the offense was awaiting a hearing on a charge of public swearing and intoxication, and in February he was sentenced to four days in jail for petit larceny.

Just the kind of immigrant the Democrats would love to have as a new American citizen.
