PHOENIX (CBS5) -

A 48-year-old Phoenix man was arrested after police said he shot a homeless man who walked into his front yard late Friday night.

Donald Jackson Taylor was arrested and charged with one count of misconduct involving weapons after the incident.

Police said a 57-year-old transient man with a history of threatening people in the area walked into Taylor's front yard and began shouting at him at about 11:30 p.m. Friday.

Taylor told the man to leave and warned him not to come any closer, according to police. The man continued to walk toward Taylor, who reportedly fired one round from a shotgun, striking the man.

My rule of thumb is, when someone with a shotgun tells me to leave and not come any closer, I usually follow his instructions to the “T”. It has worked out well for me so far.

Under North Carolina law that would have been a bad shoot. I don’t know about Arizona law.

Well, that may work for you, but obviously not for everyone.

I've said it before, and I'll say it again: Anyone that shouldn't have a gun should remain in prison. Anyone out of prison should be allowed to have a gun.

Herein, I believe, lies the problem:

Police said Jackson was prohibited from owning firearms because of a previous conviction about three decades earlier in another state. He was booked into Maricopa County Jail.

It would be nice if we knew the nature of the conviction or the other state.

While this sounds like a clear case of self defense, they can still get him on what is a likely BS firearms charge. He should have used a crossbow or a samurai sword.

Does that extend to voting rights as well? Maybe it should. "Paid you debt" should mean just that.

His conviction 30 years ago could have been for misdemeanor domestic violence incident, which retroactively took away one's gun rights after the Clintoon era Lautenberg Amendment of 1997.
