"Michelle and I were deeply saddened to hear about the passing of Sally Ride. As the first American woman to travel into space, Sally was a national hero and a powerful role model. Even if something were to happen to her, there's no way that they'd get a new SCOTUS Justice through the confirmation process before then.
There is the mechanism of a recess appointment. However I don't think that there's ever been such to SCOTUS. In any event, if Ruthie were to assume room temperature you'd see Boehner keep the House in session to prevent such. And I don't mean the kind of barely-functioning one that's allowed Obama to claim they were really in recess with at least one recent appointment.
PLUS such an appointment would seriously hurt Obama by ticking off independents and royally ticking off Conservatives. History (FDR's court-packing attempt) has shown that the swing-element of the US public really doesn't like it when the President starts playing games with the Court. If Obama were to set up a Constitutional crisis (and it would be such) leading up to the election it would allow the Republicans, at the least, to highlight ALL of his extra-Constitutional activities in a way that would present a very clear picture to an awake and paying-attention voting public.
