Jerry Sandusky case: Lawyers say they've found Victim 2, the boy Mike McQueary saw being molested

Victim 2, the boy who was, until now, known to exist only because Mike McQueary saw him being molested by Jerry Sandusky in a Penn State shower in 2001, has come forward to two State College lawyers.

Andrew Shubin and Justine Andronici, two lawyers who launched their own investigation into Sandusky's activities over the last four decades -- and the reactions of people around him -- say that Victim 2 has identified himself to them.

As part of the investigation, they acquired voicemails from Sandusky to the man, and released those on www. rossfellercasey.com, the website of the Philadelphia law firm they are working with.

In both, Sandusky ends the message with "love you."

They released a statement that reads, in part:

"Our client suffered extensive sexual abuse over many years both before and after the 2001 incident Michael McQueary witnessed in the Penn State Lasch building shower.

"Penn State has now admitted and there is no longer any question that its top officials could have and should have prevented these acts.

"Jerry Sandusky's abuse of Victim 2 and other children is a direct result of a conspiracy to conceal Sandusky's conduct and the decisions by top Penn State officials that facilitated and enabled his access to victims.

Sandusky couldn’t have gotten away with it for as long as he did without some very powerful people covering for him.....I believe if they start investigating what happened at The Second Mile, they will uncover a hornet’s nest.

“Jerry Sandusky retired from Penn State in 1998 correct and was not part of the University - he was in his own charity that the Univ allowed his and other charities access to the football facilities.

Because Penn State is a “non-profit” they could limit thier liabilities in court. The Archdiocese of Boston used this to stop future lawsuits an end the litigation and make a one time payment agreed to by the victims lawyers.

Jerry Sandusky had an office at Penn State and access to the Penn State facilities up until November 2011. Jerry Sandusky made recruiting trips and spoke on behalf of Penn State at functions up until November 2011.

They would. It’s difficult to fathom so many people would cover up Sandusky’s behavior and not be involved in the actual molestation. After all there are not consequences, except being called a hero, to turning him in and sending him to prison. There are, however, consequences when you aid and abet by covering up crimes. There is more to this than you or I will ever know.

I posit this question . If a coach condones credit card fraud by another coach— ok, he is aware the other retired coach murdered his wife, would this justify the sanctions agreed to by Ped State? Why is is relevant to football? Why has the school football program been destroyed? Who were idiots representing Penn State? Sanctions have in the past related to a violation of NCAA rules. Do we now have a rule that if we know of a crime committed by anyone in the program— we banish football.We punished 87 innocent football players for the acts of two retired employees? This was a horribly stupid act by Ped State and the NCAA and totally misplaces the blame. I can understand get Pedterno’s name off campus but DESTROY FOOTBALL? unbelievable.

It doesn’t really matter one way or another.

He had keys and an office to Penn State’s facilities given to him by the President of the school. He committed crimes at Penn States facilities. The school knew of problems that Sandusky did while he was an employee as well as when he was retired using the locker rooms and showers for his assaults.

I'm still unclear why Mike McQueary isn't sitting in a jail cell. How someone could see that and NOT immediately call the cops I do not understand.

I’m curious as to how they “found” the victim. Did the person come forward, or did they know the name and just couldn’t locate him prior to this? Obviously, the victim knew this was all going on, and it would seem he didn’t WANT to come forward. I can’t imagine what the man must be going through now... Talk about ripping off a bandage and opening wounds - and especially if you aren’t prepared for being confronted by these things... It can seriously screw a person up, even if they’ve achieved stability and have dealt with the issues.

The money isn’t any real consolation for the suffering he has already gone through, what he will be put through in court, and what he will suffer with the rest of his life - whether he is able to move forward and accept the past (become a survivor), or not. It may be stress off the person’s back as he probably won’t have to worry about work, and could concentrate on his wellness, and living. But, it’s not going to take away any of the pain...

As for those who allowed this to happen, covered it up, etc... I really don’t have any words that I can say here neither about how I feel about the monsters, nor what I think SHOULD be done to them.

Football has not been banished at Penn State.

Football was the conduit that created the culture allowing the crimes to be committed.

Joe Paterno wrote a long letter defending Penn State and the football program before he died.

Joe Paterno never wrote a letter expressing remorse and sadness for the children victimized.

Sandusky used the football program as way to gain access to his victims. Sandusky was protected by the school and treated differently then if he was a lowly employee accused of similar crimes.

The NCAA punishes programs all the time caused by a few individuals.

The NCAA did not destroy football at Penn State. Penn State destroyed their football team.

Evidently, Paterno was not the only one who knew and covered up for Sandusky. There were several others on staff(that we know of) who helped cover this up. All of them should be prosecuted and the school should be fined. Taxpayers should not have to continue supporting this kind of behavior.

If I were a ball player I would not want to play for Penn State at this point. That university willingly allowed itself to become a hunting gound for pedophiles and homosexual rapists.

Should ballplayers be punished? No, but the university should and if the team is collateral damage perhaps they will never allow it to take place on their campus again.

Perhaps he isn’t in jail because they are planning on using him as a witness, and they gave him immunity in exchange for his testimony?

As for why someone wouldn’t immediately call the cops - I don’t understand that either, and I never will. I mean it was a CHILD - not even a teen that the sick b*st*rd could lie about having a consensual relationship with. It baffles me.

Like the Catholic church's crimes many of the victims did not want to come forward for fear of reprisal from the church and community. If you read the grand jury's report Sandusky groomed his victims starting aroung 8 or 9 by picking fatherless children with low self esteem. The D.A. stated that all of the victims did not want to testify against Sandusky because he was so powerful and revered. The D.A. had to make a secret rendezvous with McQueery far from campus to get him to talk. The D.A. knew that if it got out that McQueery was talking to investigators Penn. State would try to intervene.

The most extensive - by far the most extensive - treatment I've ever found on Ray Gricar's death and all of the elements involved in it is Ray Gricar mystery: DA's privacy adds to intrigue surrounding his disappearance.

Among other things, the article mentions a long-lost dictation tape from Gricar dated months after a decision had been made not to prosecute Sandusky for the first 1998 showering incidents:

“Oct. 13, 1998. Schreffler, Ralston, Sloane, Gricar. Investigation going to Penn State meeting. Ray. Fran Ganter. Ron Schreffler is taking us to the football building and I will finish this memo, Sue, and either Ray will type something, handwrite something or he’ll tell me to dictate this and I’ll give you the tape when we get back. Thanks.”

This, to me, is fascinating. What investigation was still going on six months after the charges had been dropped against Sandusky? Consider, too, that on the day Gricar was legally declared dead, Gricar's nephew said Gricar had a sour taste in his mouth and felt that Penn State football had stonewalled the Sandusky investigation.

The NCAA has shown with its Penn State decision, that it is nothing more than an associate member of NAMBLA.

How they could let ANY team from PENN STATE ever be allowed to play under their banner again is beyond me. This is an organization that knowingly put their sports program above the safety of children, and not 1 lone wolf, but systemicall the most powerful people in the administration KNEW and covered it up.

If the NCAA can’t draw the line at allowing pedophilia to knowingly go on and cover it there is no line with NCAA, just greed. NCAA are nothing more than useless whores.

On June 30, 2011, Lara Gricar, Ray’s daughter and trustee of his estate, petitioned Centre County for a court declaration of presumed death.[18] County President Judge David E. Grine approved the petition and declared Gricar legally dead on July 25, 2011.

He was missing for 6 years. This is fairly typical in cases like these unless you think his daughter is invloved as well.

I read an article here some time ago. Before the Sandusky thing became known. Maybe it was referring to Gricar. Can't remember exactly. Anyway it was referring to the extremely liberal agenda at Penn St. And speculated that he was investigating a pedophile ring of some sort. And that the higher ups were very active in the whole homo rights movement etc.

I could be wrong. Haven't heard anything else about it. But from what I remember it seemed pretty credible.

I am going to give you the benefit of the doubt and assume this is an honest question and not yet another rant from a PSU partisan.

First, in Emmert's letter to PSU when the allegations surfaced, he explicitly referred to three NCAA bylaws that directly address the general conduct of athletic officials on and off the playing field.

Second, Sandusky could have raped and murdered a dozen nuns on the fifty yard line and PSU would not have been penalized had they reported it to authorities immediately. Instead, in order to protect the viability and prestige of the football program and its leader, the university's highest official conspired with athletic officials to conceal the ongoing rape of children for more than a decade.

The NCAA is a voluntary member organization, and is free to sanction its members as it sees fit. It is not a state actor and is not bound by due process considerations. PSU is free to end its affiliation and play football as a club sport or seek entry into the NAIA or some other organization that would have them (doubtful there would be any takers). Or they can accept the very merciful fate the NCAA has delivered to them and pray the civil suits leave enough land at the university for a football field.
