Although the ACLU strongly supports same-sex marriage, a senior attorney for the American Civil Liberties Union of Illinois warned that if Chicago bans Chick-fil-A over the religious views of its management, it will be engaging in "viewpoint discrimination," Fox News reported Thursday.
The government can regulate discrimination in employment or against customers, but what the government cannot do is to punish someone for their words, said ACLU senior attorney Adam Schwartz.
When an alderman refuses to allow a business to open because its owner has expressed a viewpoint the government disagrees with, the government is practicing viewpoint discrimination, he added.
Chicago Alderman Proco Joe Moreno said he intends to block the chain from opening its second Chicago location over president Dan Cathy's position on gay marriage. Chicago Mayor Rahm Emmanuel supports Moreno's position.
Schwartz explained to Fox that "if a government can exclude a business for being against same-sex marriage, it can also exclude a business for being in support of same-sex marriage."
But we also support the First Amendment, Schwartz said. We dont think the government should exclude Chick-fil-A because of the anti-LGBT message. We believe this is clear cut.
But Moreno has already said he is not concerned with the First Amendment.

Amazing how the death of morality and the death of freedom walk hand in hand.
Those that push acceptance of homosexuality are also the ones who will eventually seek to rob us of out basic freedoms.
we don’t need no Chick-fil-a here
we just need our gun control
community organizer values in our city
hey! gangbangers! leave those kids alone!
Rahm is just another nut on the wall.

Chicago Alderman Proco Joe Moreno
If the people of Chicago weren't bed wetting eunuchs, he'd be concerned about the second.
As for the Mayor, citing “Chicago’s Values”, let’s not pretend they are to be held in esteem.
This is the guy who announced they weren’t going to “arrest their way out” of the high murder rate.
In a city that already has some of the most restrictive gun control laws on the books, how is not arresting the murderers going to help?
You have nailed it! Our Constitution was based upon Natural Law. Through Same Sex Marriage, they are throwing out the concept of Natural Law. Natural Law says 'One Man One Woman.'
That is the whole idea of the 1st Amendment, the gubmnt not punishing us for our words,
But libs claim ala Citizens’ United whining that businesses are not people so they have no speech rights. Not that libs hold others to the same rules as they do themselves anyway.
No it's not!!!!.... it's called.....
I'm curious if Chick-a-fil's pro-marriage view would fall under 'creed'.
There are laws, and there are unwritten rules.
Thgis man and the Mayor of Boston both have big mouths that they let run off.
Of course they cannot stop a business because of the views of it’s CEO. Not legally. There are other ways. They can make the inspections hard, they can make all kinds of trouble for a company through Fire inspections, building codes, sign codes, they can make their parking lots almost unable to get into, restrictions on parking. There are a thousand ways to attack Chick Fil A during and after construction, and these azzwipes are the type that will do it.
Looking at the picture #4 posted ,that guy is a fag. No wonder he is upset.
Doublethink, a word coined by George Orwell in the novel Nineteen Eighty-Four, describes the act of simultaneously accepting two mutually contradictory beliefs as correct, often in distinct social contexts.[1] It is related to, but distinct from, hypocrisy and neutrality. Its opposite is cognitive dissonance, where the two beliefs cause conflict in one’s mind. Doublethink is an integral concept of George Orwell’s dystopian novel Nineteen Eighty-Four. The word doublethink is part of Newspeak.
Rahm won’t block any new Chick-Fil-As.
He’ll just make sure that they all fail every health inspection from now until Judgement Day (or until the Cubs win a World Series....whichever comes first)
I just had lunch at Chick-fil-a.
The deportation trucks should be around shortly to escort you out of the country for something so vile...
This is just all sorts of rich irony coming from the ACLU, imo.
They just can’t catch most of these murderers, with no-snitch being de rigueur.
Having blown their cover brazenly and publicly like this, the red tape runaround will be frowned upon in court after court. I wonder if luggbutts have made the both offers they could not refuse. And now that it’s bringing public opprobrium down on Hizzoners’ own heads, the luggbutts may be more subtle about this in the future. Still it’s rich how they tipped their hand. That won’t be lived down for a long time if ever. And it all looks bad for Democrats. (Mitt, you’d be smart to just keep your gay lovin’ mouth shut and let the Democrats self destruct here.)
We have reason to worry these same types that would deny us our basic freedoms might also be willing to kill us. It's happened before ... it's the same type - the kind that force their ideas on everyone else. I hate liberal elites. I hate the New York Times.
Liberal elites don't mind discrimination when it's against the people THEY don't like... like traditional American Christians. They're the haters.
You're right - if rights mattered more than PC 'in' stuff - creed would be covered... and they should not discriminate against us based on our beliefs.
This is just all sorts of rich irony coming from the ACLU, imo.
Furthermore, in case anyone is contemplating getting all happy about the ACLU, I went over to their site and found this on their blog:
Menino v. Chick-fil-APersonally, I think this whole spat may be good for equal marriage rights in the long run. Did you see that politicians Rick Santorum and Mike Huckabee are now trying to rally all homophobes to eat at Chick-fil-A?
Im thrilled. In fact, I encourage all bigots to load up on transfats and carbohydrates. Go ahead eat your heart out on the Bacon, Egg, and Cheese Biscuit breakfast! Mmmm.
Given that polls consistently show that support for equality under the law grows stronger with each new generation of Americans, this might just might be turn out to be a happy meal for defenders of equality after all.
No, the writer is not Julianne Malvaux.
What the world needs now is love, sweet love...
Even though they are occasionally correct, like a stopped clock, I would tell the ACLU where to shove their support.
Good for the ACLU. Right on this one, and deserve much credit.
Strange that I’ve not heard a word about demonstrations and confrontations with the Mosques of Boston and Chicago on muslim views on gay marriage.
I’ve googled and googled and find nothing from either mayor on the unacceptable views of Islam regarding gay marriage.
I’m sure they’ll stop issuing building permits for new construction of mosques soon.
the Chick Filet man was a person..stating his own opinion..plenty of people dont believe in gay marriage..I for one just think its all for politics. civil union gives them the legal rights they are wanting..
I tried to have lunch at Chik-fil-a today. The place was, simply, too packed to get in the door. Had to weave my way between cars that were lined up around the block. And once I got inside, the lobby was too full. I had to find somewhere else to eat.
Looks like this boycott is going to hurt them </sarcasm>
Homofascists like this moron and Mumbles Menino can not even read the US Constitution. Grasping it is inconceivable for these assholes.
Our place was really crowded too.
Yep, that is a difference between their ‘corporations have no speech rights’ and this situation.
Try this one.
Libs believe that free speech only applies to speech that they consider civilized, which they define as opinions that agree with them.
So when Dems talk about an ‘open discussion’ or ‘honest debate’ they mean like on the Sharpton show where they all agree with each other.
I don’t care about any of this stuff.
Where does Chick-fil-A stand on declawing cats???
Having a pro-marriage “view” is a 1st Amendment right. Turning someone away at the Chick-Fill-A counter and not letting them ‘Eat-More-Chicken’ because they prefer to sleep with the opposite sex OR express that point of view, is an act of “discrimination”.

It is all acedemic anyway, as Chick Fil A is making record profits from this fiasco : )
” LOL, now I don’t care who ya are, that’s FUNNY!”
Yeah, that worked : )
“Looking at the picture #4 posted “.... Lit up my Gaydar like a Christmas tree.
Yep: Mine too. Knocked the needle clear off the pin.
just how many generations of buttpluggers does it take to extinct a species, if queerdom isnt a choice, but entirely biological ???
of course, that makes me an intolerant hater i reckon...
btt
I’m loving this whole CFA Appreciation Day thing..
It’s a giant “collective” middle finger from America to the left...
Good job, Chick-Fil-A!!!
You nailed it NFHale. I had a good time going down to my local CFA.
It’s hilarious to know this was a big middle finger to the Left. The people from PETA were out there too. People just chewed with their mouths open in approval. /s
The groups are joined at the hip. This was like a one stop thumb in their eye to all of them.
You know, seems to me that if tolerance and acceptance is what the deviants want they only thing they’d have to do to basically just live is - LIVE - and leave other people alone to mind their own business.
Acting like buttwipes, protesting, screaming, and generally just being a pain in the *sss (no pun intended) to folks is a sure fire way NOT to have people accept you. It’s like crying “RAYYYCIIISST!!!!” all the time - sooner or later, people will just say “Fine. So I’m a Racist. So what are YOU going to do about it...” You just get sick of hearing the same old crap from the same old people.
Personally, I’m sick of their whole agenda. It’s about time folks stood up to the leftards and their retarded subgroups.
This was a good day. I’m glad to see it happened on such a large scale.
Glenn Beck was ALL over this. Gotta hand it to the guy; he throws himself into the arena big time.
