Wichita, Kansas -- It is now perfectly legal to walk down Wichita city streets with a loaded gun in plain sight.
Some restrictions apply.
"Well, you've got to have the safety on," says District Court Judge Phil Journey. "And the gun has to be in a holster and on your hip."
Journey says, as a lawmaker for years, he followed a lot of changes in gun laws. Now the City of Wichita says it is enacting change.
"For this one," says Journey, "In Kansas we have what's called a pre-emption law. We enacted that law in 2005 and we had this crazy patchwork quilt And firearms owners couldn't tell when they were in compliance and when they were out of compliance with the law. And so a lot of people got in trouble for things they didn't mean to do."
While Kansas law says open carry, with those restrictions, is perfectly legal there were some laws for cities that were different. Wichita had a law that did not allow open carry. So the city asked for clarification with the Attorney General's office.
"And an Attorney Generals opinion was issued last year that said that cities could not prohibit carrying loaded firearms, but they could regulate it,"explains Journey. "And then that's why Wichita enacted their ordinance based on that AG's opinion."
The City of Wichita Government Relations office released the following to make clear what the law is and how it impacts Wichita:
"In 2007, the Kansas Legislature passed a firearms statute prohibiting local governments from enacting ordinances which prohibited the open carry of firearms. “Open carry” means that the weapon is clearly visible to others.

Is Wichita saying that you cannot open carry with a shoulder holster?
If not, than carry it concealed. That’s what’s nice about the shoulder holster.
Additionally, I’ve been looking for the manual safety in illustrations of revolvers and Glocks. Help me?
On a Glock, it’s technically that little lever in the middle of the trigger. Or so their literature says.
And I guess you have to carry a Webley or Eley’s revolver.
My Ruger SP101 .357 Mag hammerless revolver has double action as its safety. The fact that the finger pull requires more force than an auto pistol is the safety.
What the hell?
So, Glocks, Kel-Tecs, revolvers and all other double-action and trigger-safety handguns without a safety switch are banned from open-carry in Kansas?
