Skip to comments.REESE TRIAL – Judge throws out Money Laundering Conspiracy Charges (ATF NM)

After hearing motions to dismiss all counts against the Reeses on a previous day, the Judge made it clear during a hearing and other times when the jury was not in the courtroom that he was having trouble with Counts 29 & 30, Monday Laundering Conspiracy against all four defendants.
This morning, prior to the Jury coming in, Judge Brack granted a Rule 29 Motion to Dismiss the Money Laundering Charges. The Judge stated there was INSUFFICIENT EVIDENCE, NO AGREEMENT, and NO EVIDENCE.
The charges against each individual separately that have gone to the Jury this afternoon are:
COUNT 1 Conspiracy
COUNTS 2-10 Making False Statements in Connection with the Acquistion of Firearms
COUNTS 11-28 Smuggling Goods from the United States
Not all individuals are charged with each of the county (For example in Count 9, only Rick Reese is charged; in Count 10, only Terri Reese is charged, and so on.)
Additional information about these charges will come out in the Closing Arguments by Defense and Prosecution.

After the case got some publicity, they got better attorneys than the public defenders.
We will see if the jury finds lifelong criminals more credible than upstanding members of the community who operated their business for a lifetime.
Not to mention the fedgov strong-arming gun dealers into selling semi-auto “assault rifles” to scumbag narco killers.
Anybody arrested for those crimes and the 300 resulting murders yet?
It’s all about the money. That’s why the feds went after them they had quite a lot of assets and as one of the agents stated before they get a “bonus” or percentage of the take. Talk about an incentive to steal!
After reading through most of the blog entries for this trial I have to say that the number of Federal agents that brag that they socialize with the Mexican cartels is more than a little disturbing and suggests that quite a few of them are probably on the take. What’s amazing is that they don’t even try to hid it and it seems to be a source of pride to them.

Ditto. Due to an old Gannett/Media News Services copyright complaint, FR can not print or even excerpt stories from the Las Cruces newspaper. So this type of reporting is needed for us to know what's happening with this jackboot fed government prosecution.
Has anyone sent this stuff along to Issa? It seems that most of the coverage is local.
Don't know. But one of the defense attorneys is Pete Domenici, Jr., son of our former US Senator.
Anyone who reads the Tea Party synopsis can understand how scrupulous the Reese's were in following federal guidelines when selling weapons, passing federal audits (before the sting operation) or having just minor discrepancies on the voluminous paperwork.
Totally off the subject at hand. Wow! Read this! I just found it and I’m shocked!

Update- A jury found Rick and Terri Reese each guilty of one count of making false statements in acquisition of firearms and Ryin of 2 counts. The jury acquitted all family members on all gun smuggling and conspiracy counts, and most of other false statement counts. Reese was not found guilty of anything and has already been released.
It doesn’t say when they will be sentenced.
This sucks because even though they were cleared of all the other charges the convictions make it so they can no longer vote or own guns. I hope they can appeal.
