Updated: Three of four members of family convicted in gun sales case

4:34 p.m. – LAS CRUCES – Jurors in the trial of a Deming-area family accused of selling weapons to buyers who shipped them to Mexico convicted three of four members of the Reese family of making false statements on federal forms related to gun sales.

A fourth member of the family, Remington Reese, 20, was acquitted on six smuggling charges and a conspiracy charge as the jury voted not guilty on 24 of 28 charges against the family.

They were acquitted on 24 of the 28 charges but convicted of false statements on the Federal forms related to gun transactions. Because of that the Feds took them and threw them back in jail again. Read the Las Cruces Sun News story and my earlier link and be prepared to be enraged. Note how the headlines differ between the wire service report and the local newspaper

Kangaroo Court. the same type Zimmerman has to face.

Our Judges are no better than the Jidges found guilty at the Neuremburg trials. The Goverment tells them how to find the defendents.

I believe the whole trial was another attempt by the Obama administration to put a chill on, if not deny, the rights of gun owners to purchase guns and gun dealers to sell them.

Though they were convicted of making false statements on the forms (incorrectly copying a serial number was one of them), they were acquitted of the much more serious crimes of knowingly being involved in selling firearms and ammunition to straw purchasers who were arming Mexican cartels across the border.

One of the biggest problems in the Federal system. They can’t “get” them for what the big stuff for nail them for lying just for marking a wrong box.

Bigger problem is that this even went to trial.

Guilty of filling out the federal form 4473 that purchasers and sellers must complete. Here is the testimony of Rick Reese who explains what an unannounced ATF audit found:

Rick went over items noted on the notice of violation from the 2008 inspection, which covered an approximate one year period. He described that a major failure would be failure to report a model or serial number of a weapon. When reviewing the errors, on one 4473 form, they missed checking off if the weapons was a long gun or hand gun. On another, they missed putting in the NIC number (the number from the NCIC background check). http://www.lunatpp.org/

I don't know whether these were the violations that the jury found were the false statements, but they may well have been.

This is the way prosecutors work on someone that they “want” to get. Make multiple charges, hoping the jury will figure that if they aquit on 90 percent of the charges, and only convict on one, that they will be doing the defendant a favor. One conviction is all that it takes to ruin a persons life, and take all that they had. This is an outrage.

Sadly true, juries figure that they must be guilty of something otherwise why would they be charged with all these crimes? Pathetic I read the blog with all the testimony and you could tell that the cops were lying through their teeth on this and it looks like they were targeted because they had assets that the Feds could seize and the agents would get their little bonus as part of the take. Totally corrupt.
