GOP prepares to file lawsuit against Holder
NBC ^ | August 3, 2012 | Frank Thorp

Posted on 08/03/2012 9:32:16 AM PDT by jazusamo

House Republicans will file a civil suit against Attorney General Eric Holder during the August recess, House Oversight Committee Chairman Darrell Issa (R-CA) has told NBC News.

House Republicans will file suit in an effort to compel Holder to release documents associated with the failed "Fast and Furious" gun-walking operation.

"We'll be filing a civil case during the break," Issa told NBC, "We will expect a day in court before a federal judge, which we have a 100 percent chance that the judge will hold that these documents should be delivered."

During negotiations between House Republicans and Holder in June, the White House invoked executive privilege on the documents Issa had requested for his investigation. Issa says that a federal judge should find that executive privilege does not apply to the documents he is requesting.

Excellent. Judicial contempt has actual consequences like arrest and jail until the subpoena is complied with.

So, the remote from NBC news references “House republicans” but should it not actually have been the House Oversight Committee that is taking the actions?

Its ridiculous when you think Congress must use the courts to settle this.

Congress, the body we people elected to represent us, should be the authority that strips this guy to the bone. They should not be dependent upon the courts to get things done to an unelected bureacrat.

Only because we have a lawless administration is the reason for having to do this.

“Excellent. Judicial contempt has actual consequences like arrest and jail until the subpoena is complied with.”

Goal for the GOP should be to make Holder’s and any allies lives as miserable as possible through the election. This way they cannot focus their energies on stealing the election for Obama.

This corrupt slow system is something to puke about. Government criminals never get caught, and if caught nothing much happens to the bastar!s that their corruption have killed or damaged Americans beyond repair.

You are so right. When corruption is being investigated the wheels turn super slow but when the majority are trying to shove something down the peoples throat that same system can move at lightning speed, such as the obamacare bill.

Does that come before or after "double secret probation?"

And it took corruption and arm twisting to make obamacare a slight majority. I think something like 70% of the American people want it repealed, too.

Interesting. I don't think there is any judge that can say a subpoena from Congress can be legally ignored. They would be disbarred.

Correct, there was much corruption in getting it passed.

I'll remember Pelousi to my dying day saying they have to pass it to find out what's in it.

I disagree. The Framers got it right when they limited the judicial sort of Congressional proceedings to the impeachment power. Aside from that, all judicial power under the Constitution resides with Scotus and other federal courts created by Congress.

Extra judicial actions by Congress (beyond impeachment) smacks of attainder, i.e. legislative punishment, which is prohibited by the Constitution.

GOP prepares to file lawsuit against Holder

If the Republicans hold the House and take the Senate in November, then look for the House to Impeach Holder and schedule a trial in the Senate in February '13. Then Holder will resign even if the new President doesn't fire him earlier. How would the line, "Impeached for Curruption" look on Holder's resume? What a disgrace to the office and to the country. Can't wait.

Zero will probably issue an executive order granting Holder immunity from prosecution under the aegis of some bogus civil rights protection for Holder. I know that’s illegal but WTF, zero has violated the Constitution so many times that no one will notice.

Judge, what judge? Does the judge have a gun? A SWAT team? Will they take a “ruling” from this judge, roll it up and poke holder in the eye with it?

This is how they are going after the guy who has most of the guns and who has no legal or ethical constraints to get in his way?

Hopefully, this serves a purpose that I don’t yet understand. I have come to have more trust and respect for Issa, but I don’t trust Boehner and company.

which we have a 100 percent chance that the judge will hold that these documents should be delivered

Excellent!

Now, what would be icing on the cake would be if this judge would be a Clinton appointee!

Agree re, the Ulsterman Report. The July 31 and August 2 interviews with WHI were some of the best news I have heard lately.

If you read them, you know how important every vote against Zippy really is.

So far, everything stated what was to happen, did.

I wonder what’s next for Holder. I know the “law suit” happened, but that’s not it.

One thing about UM is that the WHI accurately portrayed the role of Valerie Jarrett in the indecisiveness of Zippy in the Osama raid, and that was very shortly after it happened a year ago May. That has been borne out.The WSI is having an effect financially as you see the Zippy campaign NOT drawing the cash it did four years ago.

The prime directive for all of us right now is to throw Ziooy and his corrupt Communist cabal out of office.

November 6th will be the last peaceful chance we will have to do so.

So will I and I say that back in the fifties when I was in grade school people who talked that way were routinely locked up in state mental hospitals to prevent them from harming themselves or others. Idiots were recognized as idiots in those days, not elected to congress, let alone made speaker of the house. This must be the greatest of all times in the history of humanity to be an idiot.
