Unfortunately, Orrin Hatch will be the new chairman of the Senate Judiciary Committee, which could change the rules for the federal courts to streamline death penalty cases. And it’s highly unlikely that he will do it.
Just by making a few changes, there could be an effective five year limit on state conviction to execution, if a particular state was expeditious in its legal process. For example:
Require that all state death penalty appeals move to the head of the federal docket for consideration, with limited delays.
Limit mid-appeal court extensions requested by attorneys.
That is, “I want to wax my cat. Can you delay the next hearing for six months?”
Limit federal judges to appeals based on trial court error of malfeasance. Not the method or means of execution, or extraneous evidence, like statistics from other death penalty cases. A state should be assumed competent to execute a condemned prisoner without being micromanaged.
The classic rule under the English Common Law is “Does the condemned have the mental ability to understand he is to be executed, that he be able to make his peace with his Maker?”
If the answer is “Yes”, he is eligible to be executed.
Ricky Ray Rector, executed in Arkansas under then-Governor Clinton, did not meet that criteria, and should not have been executed.

On the other hand nearly twenty years on death row is a bit too long.
I wonder if he will vote in Nov.?
If he is smart enough to kill he is smart enough to execute.

I just never understand the idea of “extenuating circumstances”. Young, old, sick, smart, or stupid — if you do the crime, you should pay the penalty. I don’t want to hear a sob story. I don’t care if you were abused as a child or were just about to “turn your life around”. I want justice for the real victims. And the perp is not the victim.
Low IQ? Give him extra points based on Affirmative Action, and his IQ will be within normal range. Hey, they do it for Civil Service tests.

I only have one problem with the death penalty in those states that have the electric chair . . . problem is, they do not have “bleacher” seats!!!!!
