Capital murder trial begins in McAllen child's 2008 death

EDINBURG — A capital murder trial for an illegal immigrant accused of kicking her 2-year-old son to death began here Tuesday morning — more than four years after the child died.

Maria Almaguer, 34, stood before Judge Rudy Delgado and pleaded not guilty to the four counts against her, including capital murder, in the 93rd State District Court.

The Mexican national is accused of killing her 2-year-old son Isaias Ismael Alvarez more than four years ago — on June 14, 2008 — just a week before his third birthday.

“Isaias didn’t know his birth mother,” Assistant District Attorney Cregg Thompson told jurors during the trial’s opening statements.

The toddler lived with his father for the first year of his life, before Almaguer took him away, Thompson said. Isaias lost weight in her care and got sick, he said. So she purportedly took him back to his father and when he recovered, she picked him up again.

Isaias landed in the hospital four different times for various reasons, including a skull fracture and a broken arm, in less than a five-month period between January 2008 and the time of his death in June, Thompson told jurors.

“He was released from the hospital just a few days before he was killed,” he said.

Shortly after being arrested at the Roma International Bridge, about two days after the death, Almaguer told officers she kicked her son in the stomach with her right foot, Thompson said.

Almaguer’s defense attorney, Sergio Valdez, however, argued during his opening statements that McAllen police illegally extradited her and therefore illegally obtained her confession.

“McAllen Police violated international treaties,” Valdez told jurors.

He reiterated to the jury that Almaguer had the right to remain silent — a potential hanging point that Valdez said should allow his client to walk free.

Put her in the chair and throw the switch, then send her charred satiff to the effing Mexican Embassy.

Another reason why I think “Miranda” and “Mapp” need reversed by the SCOTUS. After every cop show in history, anyone who DOESN’T know they have a right to not talk and have a lawyer present are too damn dumb and deserve conviction and punishment.

BTW, when do we tell Mexico to shut up do as their told or we’ll force some regime change on ‘em?

American citizen taxpayers are out at least a million cleaning up the mess this POS illegal alien made. It will cost a million just in incarceration expenses because no one has the cojones to send her to the electric chair. Mothers who kill their babies and children should get the death penalty because they are demons, this used to be common sense
