A U.S. jury on Friday said Samsung Electronics Co Ltd has infringed some of Apple Inc's patents, and that all of those patents are valid.

The verdict in the high-stakes trial between the two tech giants was still being read in a federal courtroom in San Jose, California, and not all of the key legal findings had been announced.

I would love to buy an iphone, but the screen is too small for my 47 year old eyes and they dumb it down so you can’t customize it, unlike android.

What apple needs to do: Make a phone like the Samsung Note (only available on AT&T, whose network for voice calls in the St. Louis area is unacceptably weak for business purposes). Samsung has sold 10MM Notes - 5.3 inch gargantuan screen great for people who can’t see well and who want to be able to use a stylus.

Unfortunately, Apple is the only game in town for many important apps because the developers ALWAYS develop for the Apple first and some companies whose apps I NEED don’t develop for Android at all.

Nonsense. Xcode 4 is state of the art. As one fluent in Objective C, Visual Basic, Action Script, RealBasic, and MS C++. I can say that Xcode is my favorite IDE. It beats Visual Studio hands down in its simplicity and raw power.

Xerox’s suit was dismissed because they took too long to file it. Apple was suing MS at the time and if Xerox sued Apple and won then both Apple and MS would have been liable to Xerox. Interesting enough is that Apple didn’t win the “look and feel” lawsuit against MS. Except for one tiny thing, the trash icon.

In 1979, Apple was planning a business computer and arranged a visit with Xerox Parc research center to view some of their experimental technology. It was there they discovered the mouse, invented by Douglas Engelbart while he was working at SRI International (SRI); the mouse had subsequently been incorporated into the graphical user interface (GUI) used on the Xerox Alto. During an interview, Engelbart said "SRI patented the mouse, but they really had no idea of its value. Some years later it was learned that they had licensed it to Apple for something like $40,000."

It is a true patent. Patents come in two basic flavors, a utility patent which covers a function action or process, and a design patent which covers, well, design.

A design is the shape and feel of something, a trade dress. The “look” that defines a product line.

Apple knows which of 3-4 hard drives, 2-3 video cards, and controls their BIOS. They have nothing near the variance that the PC has in architecture. The new machines have to be sent to the factory for a ram upgrade.

A $1500 Macbook Pro has parts worth about $500 - 600.

They have the luxury of no competition and only a few new products every year.

I may be wrong about this, but my understanding is that patent and trademark law only applies to protection of designs, materials and emblems/shapes to the extent that the holder needs them to identify the unique characteristics of its own product in comparison to other similar products.

Therefore, the protection of the Coca-Cola trademark on the shape of its bottle would only be enforced in terms of its use for other beverages. If a manufacturer of motor oil or laundry detergent, for example, wanted to use the same shape in their bottles and had a brand name that consumers would never confuse with Coca-Cola, then they could probably do it without running into any legal problems.

Very dissimilar products and services can have similar trade dress, names, shapes, logos etc.
