DA won't file felony case against man who claimed responsibility for Chick-fil-A vandalism

Los Angeles County prosecutors declined today to file a felony case against a man who publicly claimed responsibility for vandalizing a Chick-fil-A restaurant in Torrance with the words "Tastes Like Hate" in protest of the company president's comments against same-sex marriage.

"... It is the conclusion of the District Attorney's Office that this is not a matter for which felony prosecution is appropriate," wrote John Zajec, the head prosecutor in the Torrance office. "The matter is therefore referred to the Torrance City Attorney's Office for consideration of possible misdemeanor prosecution."

A representative from the Torrance City Attorney's Office could not be reached for immediate comment.

Manuel Castro Jr., 30, and an unidentified perpetrator painted the words "Tastes Like Hate" with the stenciled image of a cow holding a paint brush on an exterior wall of the new restaurant in the early morning hours of Aug. 3, according to the charge evaluation worksheet.

It cost the restaurant's owner "approximately several hundred dollars" to have the affected portion of the wall painted over, according to the document.

Actually I agree it's not a felony. But it should be a misdemeanor, with restitution, and lots of community service. Plus it has to be disclosed every time he applies for a job.

Let him 'splain himself to potential employers. Sometimes that's the worst punishment of all. Coming up with a reason why a grown ass man would be so stupid, but you should hire him anyway.

I swear people, I believe the time has come for vigilante justice. If the law won’t do it’s job (what we pay them to do with our taxes) and they won’t enforce the laws they swore they would enforce, then they leave us no choice but to take the law into our own hands and dole it out as needed.

There is now law now, the left have been given the go ahead since the panthers were let go and charges dropped.

Man goes into a building and attempts to shoot many people, it;s a political shooting based on hatred.

Now we find that its not a hate crime or political, not that I think hate crime laws are what we need but if the left wants these laws then they should abide by them.

We have states being sued, we have depts being sued , we have businesses and people being intimidated, boycotted protested , basically NAZI thuggery by the left and the homostapo and the media has covered for them.

We had a laywer from the DOJ saying that they were told that black or minority crime on whites to be ignored.

We have the modern version of NAZIism and we still have saps trying to appease the media thinking th emedia might like us and other saps saying we shoudl work with the radical

The gaystoppo and the Obamanazis make the rules for us, their enemies. They don’t intend to live by them. Those rules are to keep them in power.

This is what leads me to believe that CW2 is going to happen. This is the lit fuse and baby, when she blows, she’s really going to go boom.

I’ll fight this bunch of punks like we did the Nazi’s back in WWII. I probably won’t survive but I wouldn’t want to live in a country ran by their ideals anyway. But I can tell you this, I’ll do my best to take some of them with me.

The dividing line between felony and misdemeanor prosecutions is the cost of repairing the damage. Four hundred bucks makes it a “wobbler”, which could be either a misdemeanor or felony prosecution. As a practical matter, felonies aren’t filed until considerably above that level. Remember, a felony involves a prison sentence. This is much more a “repair costs plus ten days picking up trash” offense. City attorney should handle it.

It’s also worth noting that if the situations were reversed, the Torrance city attorney would be getting a lot of Astroturfed pressure to prosecute.

Sure it’s not a hate crime.

Just try spray painting something similar on the wall of a gay pride organization and see if they are so charitable with the classification of the crime.

What the Leftists would do is HIRE someone to first remove the words, prime paint, then final coat. Can’t be done for under $400.

The mistake CFA did was just paint over it as cheaply as possible: $400 or less.

Given that they want out of this controversy, they did the smart thing.
