NY police accidentally shoot shop worker to death

NEW YORK — A police officer shot and killed a convenience store worker who plowed into him on a sidewalk while frantically fleeing an armed robbery early Friday, a sudden encounter that the police department called a tragic accident.

Three men taken into custody at the shop after the shooting were charged with murder, robbery and weapons possession, prosecutors said.

Dramatic security video released by police shows the uniformed officer, his gun drawn, positioned outside the Bronx shop's front door moments after a 911 call. In a flash, the store manager rushes out the door. Closely behind with his head down is Renaldo Cuevas, who runs full speed into the officer, sending both men tumbling to the sidewalk.

A pool of blood appears to form on the ground the instant Cuevas lands on his back. The officer is kneeling and pointing his semiautomatic at Cuevas when the video clip ends.

Investigators believe the impact of Cuevas running into the officer caused him to fire one round, striking the 20-year-old victim in the left shoulder, police Commissioner Raymond Kelly said at a news conference. Cuevas died later at a hospital.

Run into a cop and die. But not to worry, they’ll find someone else to punish for it.

Not anymore. What a miserable shame. At least this incident appears to be a real accident, not a firing squad execution as in some jurisdictions.

Sad.

But if it happens you run into someone with a gun drawn, *stuff happens. And mostly bad stuff.

I am usually very critical of the law enforcement community but this sounds like a simple tragic accident.

The victims family will be compensated($$$ does not replace a son/brother)....and the officer will live with it forever.

Crappy deal for all involved.

Seems to me Bloomberg pretty much never gets criticized for these things....If Rudy were still the Mayor, they would have jumped all over him for these shootings.

Why is it the last thing many LEOs learn is trigger finger discipline?

Look at any photo of our troops with a weapons: it is the first thing they are taught - and they learn it well.

While I no longer trust that cops do the right thing, I also don’t automatically assume they didn't do their best in a really bad situations...
Prayers sent for this murdered mans soul, a robbery victim, and for his family and friends.
And also to all the policemen involved, who will also have to live with the consequences.
And I pray that God damns to Hell the criminals who crafted this situation.

Flanagan's wife, Morgan Fairchild, had no comment on the incident.

I stand partly corrected: when the LEO drew,it appears that he started off with his trigger finger in the extended “safe” position. Later on, the view is blocked...

Officer had his gun out and pointed at the first guy, when the kid comes flying out the door. It looks like he might have panicked and shot him, but it’s hard to tell for sure. I was imagining that the kid ran into the cop more straight on. I’m sure he’s probably second guessing himself now for sure.

I used to automatically give officers the benefit of the doubt. But their training and interaction with citizens since they became an occupying force in the Fed’s “war on terror” (criminal and citizens, in general) no longer automatically deserves trust.

But seeing the tape, in this case, it looks to me like the first guy fleeing - one of the criminals - pointed at the innocent victim following him out of the store. Also, the police officer had to have his gun out because it was a violent mob action and no way could he defend himself against all those thugs without a gun.

What a miserable outcome. God bless everyone. :(

Guns are dangerous. Cars are dangerous. Machinery is dangerous. Accidents happen.

The cop doesn’t look 100% comfortable or in control of his weapon and his finger could have easily been on the trigger already and the collision caused him to fire. Even though maybe it should not have been on the trigger yet, I’m certainly not going to sit in judgement of him.
