IRS: Agents Won't Be Enforcers of Obamacare Mandate
Reuters via CNBC ^ | 11 Sep 2012 | staff reporter

The Internal Revenue Service on Tuesday assured congressional lawmakers that agents would play no role in enforcing the controversial requirement that Americans buy insurance under President Barack Obama's health care overhaul.

"IRS revenue agents will not be involved. There will not be audits," IRS Deputy Commissioner Steven Miller told a subcommittee of the tax-writing Ways and Means Committee in the Republican-controlled House of Representatives.

This is weird. Will they separate the taxes you owe from the “taxes” that are Obamacare related? Sounds unlikely.

That’s exactly how I *read* it.

Kinda like the bicycle helmet law in CT, [riders under age 16 *must* wear a helmet].....but there is no penalty to child/parent *if* they don’t wear one.

Obamacare called for 19,000 additional IRS agents. I don’t think they were intednded to process medical claim forms.

Except the law specifically forbids enforcement of the person mandate short the IRS keeping a tax refund, so you can just reduce income tax with-holding and not pay it. It was written that way on purpose. That is the irony of the whole debate.

Once people figure that out many will just stay uninsured till sick like they do in NYC, driving up insurance prices.

Ironically it is Republicans who keep implying that this is a real mandate for better or worse.

As the program works, it’ll cost *more* to collect the fees, than the revenue stream *predicted* to generate them. Count on that.

The key is in the semantics. They say “revenue agents” will not be involved.

The enforcers will have a different title.

Actually the way I understand it, the answer is yes. It seems that to get enough senators on board to pass the bill, the democrats were forced to add a provision baring the IRS from using any of their enforcement mechanisms to collect the tax. So essentially all they can do is send you a letter saying you owe "x" dollars, they also can use any refund you may be due to pay toward the fines, but other than that they can't put any garnishments, bank levy, property seizure or take you to court over them. So as long as you can fiddle with your taxes so you don't get a refund at the end of the year, you can ignore the mandate with impunity.

RE :”By the evening news, Pelosi will be interviewed...*explaining* all of this.”

I do miss Pelosi as Speaker, those days were much more fun than Boehner, every-time she did a press interview she got in trouble. Now Republicans are the scape-goat again.

Dems explanation is that those who are uninsured who they deem as being able to pay are freeloaders. The others get it free. they say it all the time.

If the GOP falls for these empty promises when hundreds of IRS agents have been hired to audit forms to see if taxpayers are complying with ObamaCare, the GOP needs to close up shop and let a conservative party that has a clue run for office.

Are their lips moving?

There is an element of truth here. In reality it will be your tax preparer that will enforce the requirements. IRS will enforce and penalize them. In reality, all tax preparers now work for the IRS now, must be certified by them and if not, their permit will be renounced.

Charles Boustany, the Republican who heads the subcommittee, handed out a paper blasting the law as an "explosion of regulatory burdens."

The law contains a number of new tax provisions, from the so-called individual mandate to tax credits for small businesses and levies on the wealthy to help pay for coverage.

Dems are in charge - when we vote out Obama life will get easier. Are you on board with that?

**... as I said, the media can't spin this story -- but that means they’re going to memory-hole it -- just like they're memory-holing the fact that 75% of the ObamaCare burden will fall on the already drowning middle class.

After all, Americans need to know about Ann Romney's horses and Mitt's jet ski and Seamus and to be told more lies about Bain's outsourcing and, and, and, and, and…. **

Well, it's good to know ObamaCare is creating jobs somewhere

You can’t ignore them, but you can tell them that you know the law and tell them to G- F-— themselves...

“The individual may stand upon his constitutional rights as a citizen. He is entitled to carry on his private business in his own way. His power to contract is unlimited. He owes no such duty [to submit his books and papers for an examination] to the State, since he receives nothing therefrom, beyond the protection of his life and property. His rights are such as existed by the law of the land [Common Law] long antecedent to the organization of the State, and can only be taken from him by due process of law, and in accordance with the Constitution. Among his rights are a refusal to incriminate himself, and the immunity of himself and his property from arrest or seizure except under a warrant of the law. He owes nothing to the public so long as he does not trespass upon their rights.”

U.S. Court of Appeals Rules IRS Cannot Apply Force
Against a Tax Payer Without A Court Order

Taxpayers Free To Ignore An IRS Summons

Queensbury, NY – On January 25, 2005, the U.S. Court of Appeals for the Second Circuit held that taxpayers cannot be compelled by the IRS to turn over personal and private property to the IRS, absent a federal court order.

Quoting from the decision (Schulz v. IRS, case number 04-0196-cv), “...absent an effort to seek enforcement through a federal court, IRS summonses apply no force to taxpayers, and no consequence whatever can befall a taxpayer who refuses, ignores, or otherwise does not comply with an IRS summons until that summons is backed by a federal court order…[a taxpayer] cannot be held in contempt, arrested, detained, or otherwise punished for refusing to comply with the original IRS summons, no matter the taxpayer’s reasons, or lack of reasons for so refusing.”
