By improperly causing a hearing to be removed from the court calendar, the Bureau of Alcohol, Tobacco, Firearms and Explosives prevented a Federal Firearms Licensee from seeking discovery crucial to its case for a scheduled revocation hearing, a motion filed on behalf of Brinks, Incorporated, in the United States District Court for the Northern District of Texas at Dallas asserted Monday. Requesting either to reinstate [the court] hearing date or, in the alternative, to reschedule [the] FFL revocation hearing, the motion points out it serves as Brinks only opportunity to obtain discovery for the purposes of defending its license.
This follows up on a story reported last month by Gun Rights Examiner, where the security firm, which maintains an FFL, was fighting an ATF notice of revocation it maintains is illegal and against ATF's own policies.
The revocation, if not reversed, will prove costly. Per a Courthouse News Service report, Brink's says it owns more than 14,000 guns, which are used by its 9,000 employees in 220 branches across the country.
Violations found during inspections in 2000 and 2002 did not result in administrative action and no violations were found in subsequent inspections in 2005 and 2006, the Brinks discovery petition states, making the draconian revocation decision even more inexplicable. Brink's has never received an ATF Warning Letter, nor been asked to attend an ATF Warning Conference, at any time in the past.
In this latest development, a court hearing was scheduled for this Friday, and the ATF revocation proceeding wasnt scheduled until the following Tuesday. But ATF told the Court that they werent served properly and the Court took the Friday hearing off the docket.

So what is the atf’s purpose for doing this? To disarm those who guard our cash? Why? So the cartels can rob Brinks Armored cars?
The ATF's mission is to disarm everyone except government JBTs
I live a couple of miles from Quantico and there are men in combat uniform walking around the area stores. These uniforms are not standard to any one service and not standard within the groups of men. When I ask them what they are doing they refuse to answer but then one day I was told they are law enforcement agents from all over the Country and are here training in the same areas where the Marines train their troops at Quantico.
This is scary stuff and these men all look like the types I see around who would follow any orders given them, including the apprehension or shooting of Innocent law abiding citizens.
I have never been a conspiracy type person but I now fully believe the Government is training law enforcement the tactics needed to suppress the civilian population and ensure they can take out any and all who resist.
"Arbeit Macht Frei"
ALL governments evolve to the same end. It's just that some break before they get there and others take longer to do it.
And I still wonder as to how these guys can face their neighbors and supposedly friends and children as neighbors. I believe history gives a lesson that governments, legal or otherwise, are capable of instilling a behavior in people that is not to be trusted. I think our Founders realized this.
Right now we have had MANY reports of OTMs (other than Mexican) apprehensions not being South American or Salvadoran, but Arab or from an Arabian country. These people were living in Mexico, learning the Mexican way of speaking and acting with a purpose of establishing cells here in the US. They have been trained in military tactics.
In order to combat these invaders, LEOs need to be trained in military tactics also in order to be effective. When these scum decide to attack a school (read “Terror at Breslan” in you want to find out their agenda) response needs to be immediate and deadly. The average cop does not have the experience or training to be effective.
This is why I believe this training is necessary.
Having said all that, I will tell you that I have DOD manuals that detail the process for building internment camps and the process for interning civilians. It is a double edged sword to be sure. Here in Maricopa County, I know which way the wind blows and am not concerned. After November, my attitude may change.

So, did BATF make a false representation in court? Is there a legal penalty for that? Should there not at least be a contempt of court charge against their attorney, and any and all parties complicit in this false representation?
That is my take on it. I can pretty much guarantee that the ATF will say that it was a bureaucratic snafu, they are so sorry, it will never happen again... while at the same time insisting that the licensee have their license revoked because it is all so important that it be done *right now*.
I would love to believe that the judge would have the guts to hold them in contempt, but the ATF and the federal law enforcement agencies strike fear into many hearts.
