Seeking to reduce runaway obesity rates, the New York City Board of Health on Thursday approved a ban on the sale of large sodas and other sugary drinks at restaurants, street carts and movie theaters, the first restriction of its kind in the country.
The measure, championed by Mayor Michael R. Bloomberg, is certain to intensify a growing national debate about soft drinks and obesity, and it could spur other cities to follow suit, even as many New Yorkers say they remain uneasy about the plan.
This is the single biggest step any city, I think, has ever taken to curb obesity, Mr. Bloomberg said shortly after the vote. Its certainly not the last step that lots of cities are going to take, and we believe that it will help save lives.

No doubt the same panel that will decide if granny gets a heart transplant based on her years of quality life.
Why have We the People rolled over on this?

What’s the penalty?
Simple solution give the drink away with a meal or one of them great chili dogs just raise the price to cover the drink whats not sold can’t be proven it was even there !

I suspect a payoff somewhere- Big Gulps are still allowed because the ban doesn’t apply to convenience stores.
There are some people who cannot drink diet soda. People with PKU (Phenylketonuria) cannot break down the amino acid phenylalanine. Diet drinks with NutraSweet (aspartame) contain phenylalanine. Not sure how many diet sodas contain phenylalanine.
Somebody needs to piss in these busybodyies’ coffee.

I don’t believe thise would survive a class-action lawsuit. All that would have to be done is to compare what the “health department” used to determine that it fit whatever regulations specify it as “unhealthy,” and then just show the zillion other things that meet or exceed said regulations “unhealthiness” that are still legal. And then simply make the argument that sugary drinks are either allowed, or all those other zillion things must be made illegal too.
Sheesh, don’t lawyers even know how to make money anymore? It really IS the end of the Mayan Calendar!
