Special Operations Speaks calls for Panetta's resignation

WASHINGTON, DC – Special Operations Speaks (SOS) today called upon Defense Secretary Leon Panetta to resign from office for his claim that Barack Obama had special authority to provide classified information about the Navy SEAL attack on Osama bin Laden to Hollywood filmmakers and others with no security clearance.

Panetta made the claim in a September 10th interview on CBS This Morning. As he threatened to punish former Navy SEAL “Mark Owen” for revealing details about the assault on the bin Laden compound in his book No Easy Day, he stated that Department of Defense release of top secret information to Hollywood filmmakers “…were authorized by the President of the United States, who has that authority…”

From a legal perspective, Panetta is correct. The President has effectively unlimited authority to classify and declassify information.

That might be a problem for the President since he won’t have anybody to throw under the bus for releasing information to Hollywood. If the Spec Ops PAC claims those releases have endangered lives Obama will be left holding the political bag.

You will note that DOJ is still studying the matter before filing charges against Owen. Translated, that means Eric the Corrupt is searching for one miniscule fact that the Food Stamp President and his gaggle of simpering fools hasn’t already compromised. Watch, Eric the Corrupt will come up with some fact like the way they laced their boots or some other nonsense as classified. What really irks the Food Stamp President and Slow Joe are the low esteem that they are held and they are out for revenge for the insult to the most high and anointed.

Obama has "special authority" from whom? Is it in the Constitution? Does he get it from himself? Does he get special authority from Panetta? Who gives Obama the authority to put American's in harms way?

True, but he is not allowed to release classified information. If he wants to legally release the information, it has to be declassified first.

Nope. The President can do this on his own by fiat. He's the ultimate classification and declassification authority. No intermediary procedures are required.

The entire legal apparatus surrounding classification and declassification is surprisingly informal (to most people) and entirely the purview of the executive branch; it's all based on executive orders.

If he declassified the information prior to leaking it. But that does not appear to be the case. Also, he said he didn’t do it (Panetta admits that he did) so he lied. Panetta’s Nixonian excuse “Well, when the president does it, that means it is not illegal.” does not negate the fact that Obama leaked the intel, put the lives of our troops in danger and deserves to pay a legal and political price for his actions. Panetta covering that up is deplorable.

See, the problem here is you are imagining there’s some sort of special classification body sitting above (or external to) the President’s control, and there’s some sort of legally mandated “declassification form” the President has to fill out in triplicate. There’s no such thing.

Now the President can DELEGATE classification and declassification authority, and set up procedures for that. But the President himself, per the extant Executive Orders, is not bound by those procedures.

The President could hold a news conference tomorrow (or authorize Panetta to hold such a news conference) and start listing the precise locations of every US submarine at sea, and he wouldn’t be violating the law. Of course, he could be attacked and criticized for releasing that information, but unfortunately under the string of Executive Orders defining classification authority (all from Presidents prior to Obama) he’s not violating the law.
