According to Harris County homicide investigators, a minor accident spilled over into the gas station parking lot. The 23-year-old woman behind the wheel of a silver sedan told them the young man walked up to her car and was yelling and beating on her window. He grabbed for her door and she grabbed her gun and fired.

If she was shooting wild near a gas station and nearly hitting a third party figure, she was dangerous to all involved.

WHICH car had been hit?

Was there a hit and run involved?

Was this an effort to exchange information?

Had one driver refused to yield right of way instead hitting the gas and the horn at the other driver?

If she HAD deliberately hit his vehicle refusing to yield, then I’d say she was using her car as a weapon which itself is deadly force.

Even if her story is the absolute truth, I don’t think it would justify deadly force. Someone banging on your window and yelling at you after an accident is most likely trying to get you to roll the window down or exit the vehicle to talk about the accident and exchange information, maybe to just vent and yell at you, but not very likely trying to cause you physical harm.
