Evansville, IN squirms and squeals in face of open carry lawsuit

Evansville, IN police ejected a gentleman for lawfully open carrying his pistol at the Evansville Zoo back in 2011.

The man, Ben Magenheimer, known to many was Titanium Frost on the Indiana Gun Owners forum, was at the zoo with his family minding his own business when police showed up and ordered him to leave. In his subsequent lawsuit, Magenheimer is seeking damages for violation of his civil rights under the color of authority.

The City of Evansville is smelling an expensive judgement in the case and has responded with a 30-page motion to dismiss the lawsuit, citing Magenheimer’s other open-carry activism. Sadly for the city, the best they can do is throw lots of fecal matter against the wall by referring to name-calling and past posts on the Indiana Gunowners website and see if any sticks.

Magenheimer’s attorney, Guy Relford, a well-known Second Amendment attorney in Indiana and also part-time firearms instructor, has thirty days to respond to the city’s motion.

The case is set for trial in January 2013.

This is typical of what we see with police harrassment of open carriers. The police stop a person and create a scene when he attempts to inform them that he is not violating the law. Then they claim that he is acting disorderly because he attempted to educate them.

Then donate the $10M right back to the zoo!, or other charity of choice. that would smack ‘em.

Less attorney’s fees and reasonable and customary personal costs of course ... (like a new Kimber or two)

I wouldn’t do that, because the zoo is probably in some way connected with the city and would find a way to “transfer” the money back. Give it to charity if you like, but make sure the money goes outside Indiana!

Donate the money to Second Admendment advocacy groups instead and let the bad guys money go to work against them! The statists don’t hesitate to use tax moneys to fight against natural rights of self-defense,free speech, and traditional marriage.

But I will say that ,in my opinion,there is little real need for open carry in urban settings.Concealed carry attracts less attention from evil politicians or neurotic persons who fear guns ,criminals, and police.

I also think every has the right to defend themselves from criminal attack. We shouldn’t have a society of multiple classes ,some of whom are denied their rights.We should aslo have a society where violent criminals don’t get released back onto the streets.

I'm sure that is why some people carry openly. I appreciate their efforts to normalize behavior which, until recently, has been outlawed by many jurisdictions despite the Second Amendment.

Here in the People's Republik of Kalifornia they have now outlawed ALL forms of open carry despite having won prior court cases by claiming that the existence of legal open carry permitted the state to restrict concealed carry.

The Kalifornia courts will be forced to recognize the meaning of the Heller and McDonald decisions. I just wish the pace was faster.

Set some of the judgement aside to support the next suit against the city. They will repeat the mistake. Make them finance their own demise.
