Court Rules Out-of-State Students Have the Right to Vote in New Hampshire

Strafford County Superior Court Judge John Lewis ruled out-of-state students have a right to vote in New Hampshire and directed the state to amend the voter registration form for the presidential election.

On Sept. 12, the New Hampshire chapters of the League of Women Voters and the American Civil Liberties Union filed a petition in Strafford County Superior Court – on behalf of four out-of-state college students – to seek relief from with a new law – originally filed as Senate Bill 318 – which requires people to sign a form declaring New Hampshire as their domicile.

The order, issued this afternoon, directs the Secretary of State to reissue the form without the paragraph which states voters who declare N.H. as their domicile must register their vehicles and obtain an N.H. license.

The state will also have to notify election officials in towns, cities and unincorporated places throughout the state to use the new form for the November election and require the state to add a form to the Secretary of State's webpage to explain the process, according to the order.

Andy Martin, a former adjunct law professor at City University of New York who lives in Manchester, filed two motions this morning - to intervene in the case to help the state and asking to dismiss it altogether.

In a letter to Lewis, Martin asked the court to withhold from issuing an order and not to let the plaintiffs "dilute or confuse the legislature's intent to enforce a ruling of the New Hampshire Supreme Court."

Associate Attorney General Richard Head, who had not had the chance to review Martin's motions, said he does not know how it may affect the case, whether the state will file an objection or whether the court will determine he has standing in the matter.

Hmmmmm.... this needs a challenge. Who will check to see if they are citizens, haven’t voted by absentee elsewhere, etc.?

Bad precedent.

Obama has a comfortable lead in CA, what stops him from importing a few million voters to one (or all) of the swing states?

Is it still voter fraud if it's legal?

But somehow our military have to mail in a request for an absentee ballot by a ridiculous due date to be able to vote????

I requested an application for an absentee ballot and NEVER received the application, and that was in Texas for the last run off for senate. Thank goodness Cruz won, but it was without my vote. Oh well, I live in San Antonio, the great city Julio, the mayor, will be the next Democrat hopeful. He's got it all, Harvard degree, etc.

That's what they're hoping.

Deployed military are forced by circumstance to vote absentee. There's no reason nonresident students shouldn't be required to do the same. Allowing nonresidents to vote in NH instead of voting absentee in their own states disenfranchises NH residents, and is an invitation to voter fraud.

THERE IS NO 'RIGHT TO VOTE'!
You acquire the PRIVILEGE of voting by joining and adhering to the rules and regulations of the group you join - and joining the group requires that you personally take some affirmative action to meet the groups requirements. Otherwise I should be able to vote for Walmart's Board of Directors, or the Speaker of the House of Representatives! I won't try as I know I do not meet those group's requirements.

I do not permit the Justice System the authority to determine what the meaning of "is" is!

They don't have the mental capacity/ability to request an absentee electoral ballot from their home of record voting precincts?

Nope.....this has been a 40 year problem in NH where “Massachusetts interests” along with the DNC set up thousands upon thousands of college students to vote in local & national elections in the state. NH is a small state & these “student” votes often change the course of events up there. That’s what this is all about.
