Masked Teenage Intruder Unknowingly Shot To Death By Father In New Fairfield

NEW FAIRFIELD, Conn. (CBSNewYork) – A New Fairfield man fatally shot a masked teenager in self-defense, only to discover the teenager was his son.

Tyler Giuliano, 15, was shot to death outside a home on Meetinghouse Hill Circle at about 1 a.m. Thursday in what appeared to be an attempted burglary. A woman in the home believed someone was trying to break in so she called her brother, Jeffrey Giuliano, who lives next door, CBS 2′s Lou Young reported.

Jeffrey Giuliano charged across the lawn with his personal gun in his hand and confronted a man dressed in black and wearing a ski mask, Young reported.

WCBS 880 Connecticut Bureau Chief Fran Schneidau reports

There appeared to be a weapon in the masked intruder’s hand, Young reported. Jeffrey Giuliano fired and the intruder fell to the ground. It was then that he realized that the person he shot and killed was his own son.

“I can’t imagine what he felt when he took the mask off,” resident Tin DiKit told Young.

“On a lot of different levels this is a real tragedy,” New Fairfield First Selectman John Hodge added.

When police officers arrived at the scene, they found a distraught Giuliano, a fifth-grade science teacher, overwhelmed with grief, Young reported.

Children have murdered parents and other close relatives for any number of stupid reasons or just outright evil .

I do think we have too many movies and books portraying depravity as acceptable,and impressionable people are swayed by such things.

So he died instantly and never knew he was shot? Because the father sure as heck knows he shot him.

I’m not sure what to think. According to the article, the kid was a member of the Civil Air Patrol. This might be case of “ shoot first, ask questions later” . There was no weapon found on the kid, and it’s not clear there was a threat of imminent harm. The guy shot before he knew. It’s hard to say if the dad was right in shooting.

The bigger question is, where did the kid get the gun the cops found in his hand?

If this was Hartford, it wouldn’t be unusual for kids to be roaming around in the wee hours, on a school night.

Cops keep stating this incident is *not* related to the recent reports of burglaries in town. Oh really?

Apparently a gun was in his hand, when the cops arrived, according to reports I heard/read. I’m sure it will come out eventually where the gun came from. Too soon to say.

...or the kid knew exactly what kind of loot he could get from his aunt’s house. What he didn’t plan on, was that she would call her brother [next door] for help. Kid had to know that father owned a pistol and recognized it was his father....and what his temperament might be. Maybe if you are a *drug crazed* kid you are not thinking clearly. Who knows?

CT does not have a castle doctrine law [that I know of], but we do have a legally defined criteria for defense as described below:

Connecticut General Statutes Sec. 53a-19.

Use of physical force in defense of person. (a) Except as provided in subsections (b) and (c) of this section, a person is justified in using reasonable physical force upon another person to defend himself or a third person from what he reasonably believes to be the use or imminent use of physical force, and he may use such degree of force which he reasonably believes to be necessary for such purpose; except that deadly physical force may not be used unless the actor reasonably believes that such other person is (1) using or about to use deadly physical force, or (2) inflicting or about to inflict great bodily harm.(b) Notwithstanding the provisions of subsection (a) of this section, a person is not justified in using deadly physical force upon another person if he or she knows that he or she can avoid the necessity of using such force with complete safety (1) by retreating, except that the actor shall not be required to retreat if he or she is in his or her dwelling, as defined in section 53a-100, or place of work and was not the initial aggressor, or if he or she is a peace officer, a special policeman appointed under section 29-18b, or a motor vehicle inspector designated under section 14-8 and certified pursuant to section 7-294d, or a private person assisting such peace officer, special policeman or motor vehicle inspector at his or her direction, and acting pursuant to section 53a-22, or (2) by surrendering possession of property to a person asserting a claim of right thereto, or (3) by complying with a demand that he or she abstain from performing an act which he or she is not obliged to perform. (c) Notwithstanding the provisions of subsection (a) of this section, a person is not justified in using physical force when (1) with intent to cause physical injury or death to another person, he provokes the use of physical force by such other person, or (2) he is the initial aggressor, except that his use of physical force upon another person under such circumstances is justifiable if he withdraws from the encounter and effectively communicates to such other person his intent to do so, but such other person notwithstanding continues or threatens the use of physical force, or (3) the physical force involved was the product of a combat by agreement not specifically authorized by law.

You do your best to give them the tools to live a good life and show them how to use them.

From there it is up to them. They become skilled artisans, lose the tools, break them, hock them...that part is up to them.

And no amount of ragging on them about it will change them if they are determined to make a mess of things.

Placing the 'guilt' on parents for a child screwing up later on is a Liberal head game, and I refuse to play.

That isn't saying parents can't mess a kid up, but I don't see that likely coming out of a good God-fearing household.

This update: Son Killed By Father In New Fairfield Was Armed With Knife

I believe that the boy was a fifth grade student and in foster care, when the two became acquainted when the boy was enrolled in the father's classroom. An adoption ensued.

State police said Giuliano threatened his father, and that's when he opened fire, killing his son.

When state police arrived at the home, Jeffrey was sitting in the front lawn and his son, Tyler, still wearing the ski mask, was dead in the driveway.

It wasn't until after police arrived and they peeled back the ski mask that Jeffrey saw he shot and killed his own son.

I suspect there will be dibs and drabs coming out. Cops say it will be weeks for the investigation to be complete.

One story, added that the cops said, it may have been a prank, gone bad.

“He didn’t know it was his son...we made the identification.” state police spokesman Lt. J. Paul Vance. He said that Jeffrey Giuliano had not removed the teenager’s mask, as was reported.

1st, I had not read that the kid had a gun. 2nd, I was projecting from my own history. Most middle class families which have guns seem to have children who understand the consequences of guns.

My apologies for saying or theorizing without 100% of all available facts. I hope you can possibly find it in your heart to be forgiving.

Turns out the boy had a knife. Early reports [linked above] about the gun were incorrect. We may never find out what really happened. The only thing new we learned, was that he was shot several times.

God help this family. The police want us to know that they were *there* within minutes of being called, as if the women who called her brother perhaps should have called 911 first, and infer that maybe this wouldn’t have happened.

There are many unanswered questions to this tragedy. As Friday night analysts...we can only speculate. Feel free to figure this out. :)
