When I used to work in the Government contracting business fines and penalties for not followng the law were classified as an "UNALLOWABLE COST" and could not be billed to the Government in any form. New era folks working under the lawless Obama admin.

the Obama administration has offered to cover expenses (court-ordered penalties, severence costs, etc) for contractors willing to ignore the WARN Act

sounds to me like someone is committing a felony.

Lockheed employees should prepare a class action suit against the company and inform them that they will proceed with filing if the company fails to issue the WARN Act notices on Nov 2nd as prescribed by law.

Even more fun...100,000 individual law suits against Lockheed for failure to notify on time.

I have been thinking about this the last month as the cooked polls tend to indicate the Won has it in the bag. It the GOP can hold the House and by some stroke of good fortune take back the Senate, would there be enough cajones between the two chambers to IMPEACH?

Lockheed has no exposure (as far as their legal department is concerned). IF Obama keeps his word, the taxpayers will fully cover any expenses.

It is not the gummint’s job to be the “insurance agent” for people doing illegal or stupid things?

As Exhibit A, I refer you to Rand Paul's recent bill to suspend foreign aid to Pakistan, Egypt, and Libya. It failed 81-10 with nine abstentions.

A few additional Senators with (R) after their names will not come close to making the kind of conservative majority necessary to convict and remove a sitting President.

Not on your life. Bill Clinton has made the office virtually Impeachment-proof for Democrats. If they did not have the stones to throw him out with the stacks and stacks of evidence, it will never happen. And hell, we can't even get Boehner to object strongly.

disagree ... promise or not, unless the deal is in writing they are breaking the law counting on the breaking of another law to make them whole. There is a risk and it is the risk that gets disclosed.

If there wasn't enough cajones to remove Slick from there most certainly isn't any to remove Zero. Anyway under no scenario that I can think will you get 60 votes in the Senate for removal!
Just having the House deliver a bill of impeachment is a waste of time. The media will spin it as nothing more then a racist political act. The soccer moms & independents will swoon as they always do when they are required to think. The Rats will wear it as a badge of honor just like Slick does.

ZERO MUST GO!
Without the brake of another term think of what illegality he and his minions will do and the media will applaud !
Getting Lockheed to break the Wagner Act will pale in significance!

Therein lies the problem. Under what authority does Obama provide the funds for those expenses?

And even if he has the authority, what if Obama isn't a position to provide them?

If I were a lawyer in HR at Lockheed, I would be pointing out that this is an empty promise, and that the company puts themselves at significant risk.

You are, of course, 100% correct.

OTOH, if they tell their shareholders and some of their shareholders are also employees, then they have breached the contract with obama, and he no longer needs to indemnity them against any penalties, does he?

So by not telling the shareholders they are insuring that the shareholders don’t need to be told, because the shareholders won’t get hurt, unless they are told they could get hurt, in which case they will get hurt.

(insert obscure quote about webs and deception here)...

Do it soon. The longer they have to contemplate the legal ramifications of deliberately conspiring to break Federal Law and the possibility of individual, personal penalties including significant prison time, the better the odds they will decide to follow the law and notify their employees.

Sure, just like they covered the costs of all those campaign visits to cities around the country ... I can't remember how many cities got stiffed on security, overtime, etc... costs because Zero wants to blow in for a few hours.

I am not sure. An agreement to violate the law is unenforceable. So if Lockheed takes this deal, gets sued and loses, the federal government would not have to keep its promise to reimburse fines, penalties, etc. If Romney wins, we could expect that Lockheed would be out of luck. In the unlikely event Obama wins, it may be that a taxpayer would have standing to sue to block enforcement of this agreement. I sure don't want my tax dollars used for this.

As another poster also suggested, this agreement may not only be unenforceable, but also illegal.

No mere citizen has standing in court. That was very thoroughly demonstrated every time a mere citizen tried to get a court, any court, to verify obama's alledged status as a Natural Born Citizen.
