ATF whistle-blower fired, claims complaints about 'Fast and Furious' played role (w/video)

A well-known whistle-blower in the Bureau of Alcohol, Tobacco, Firearms and Explosives confirmed to FoxNews.com that he was fired this week, and he claims his complaints about Operation Fast and Furious played a role in his dismissal.

Vince Cefalu said he was served his termination papers Tuesday in a Denny's parking lot in South Lake Tahoe, Calif. But he doesn't plan to go quietly.

"It will be challenged," he said.

Cefalu, who's served as an ATF special agent for 25 years, was first notified of the plan to fire him more than a year ago but had been on administrative leave until now. He said officials told him he was being canned for "lack of candor," in reference to a handful of statements he made in testimony in a separate court case.

However, Cefalu has been outspoken against ATF practices for years and told FoxNews.com that his whistle-blowing on Fast and Furious "was the final straw."

Is he a Civil Service employee? I thought they were just about impossible to fire.

I thought so too. This isn’t the end of this by a long shot. Rep. Issa warned ATF about firing whistleblowers not too long ago, I’d bet Cefalu will be talking to Issa and the Oversight Committee in depth.

NO, you can get fired from US Civil Service. It is the mailmen that can’t be fired per union contract

I wonder what excuse they used originally, to put him on leave. Because it is administrative leave, I'm assuming he's been getting a paycheck all this time. The article says he's been on leave for over a year. Since he's an agent, he's got to be a member of a union, and during that year of ordered leave, there should have been some disciplinary action filed against him by the ATF. If not, he should have been allowed to return to work. I wonder if the union ever filed any legal papers to force the ATF to let him return to work. How at this late date they can terminate him without due process is beyond me.

I know that as a NY State employee, if I was out of work consecutively, for more than year because of illness, the State could terminate me without any question. I can't imagine it's much different for federal employees.

I watched the video and I don't recall the union being mentioned but I'd bet he belongs to it. This agent and a couple others mentioned in the video were not afraid to speak out on things they considered illegal, it's clear the brass wanted them gone.

I haven’t seen any response from the union so far. This might be too hot for them to handle, but Cefalu does have an attorney so maybe he’ll sue and we will have discovery.

Thanks...I was also curious about the union. He wouldn't comment on a couple things saying he has to speak with his attorney so I'm sure a suit is in the making and am looking forward to discovery.
