Police say an eastern Indiana man has been shot dead while trying to rob a pizzeria.

Richmond police said 30-year-old Freddie McCoy of Richmond was shot by an employee of Mercurio's Pizza about 10 p.m. Saturday.

Capt. Jim Branam tells the Palladium-Item that McCoy died at Reid Hospital after being treated by medical personnel at the scene of the shooting. It's not clear from the report if McCoy had a weapon.

Just like that poor fellow who keeps on crashing his car by running stop signs dozens of times a day. You’d think he’d learn.

Owner? Employee? If it is relevant to the story at all, why not be consistent?

“A man killed in a robbery attempt Saturday night was shot once in the chest and twice in the hip by the store owner, Richmond police said Monday.

Freddie T. McCoy, 30, of Richmond died from injuries sustained in the shooting at Mercurio’s Pizza, 210 S. Eighth St., after being treated at the scene and transported to Reid Hospital, authorities said.

“We are still looking at evidence and talking to witnesses,” said Richmond Police Department Capt. Jim Branum. “But Mr. McCoy was shot three times while standing inside the building at the counter.”

Branum said an employee of Mercurio’s placed a 911 call at 10:06 p.m. Saturday about the robbery attempt and shooting. According to authorities, McCoy entered the carry-out pizza location wearing a ski mask and gloves and attempted to rob the store.

Emergency personnel responded to find McCoy on the sidewalk outside the building with gunshot wounds. Initial investigation indicated the business owner, Terry Padgett, shot the suspect during the robbery attempt, authorities said.”

“A check of Wayne County court records shows McCoy had been convicted here of nine misdemeanor crimes since 2002. Included in the list of convictions are four for public intoxication, two each for battery and disorderly conduct, and one for minor consuming an alcoholic beverage.

McCoy was charged in September 2011 in Miamisburg, Ohio, with violating a protective order and child endangering. He also was arrested in Miami, Fla., on multiple occasions this year for charges including drug possession, trespassing and panhandling.”

The above article states it wasn’t sure if the ‘dearly departed’ had a gun or not.
Seeing as how there were witnesses, and the ‘alleged’ entrepreneur was wearing a ski mask out of season this looks like a ‘good shoot’....Not sure I would dispatch him with abandon UNLESS he became a direct threat to me or the customers...
We should be able to take him out if he is taking your hard earned cash but .......

Thanks for the link. I was looking for info about what he was using to rob the pizzeria.

Police would not say if McCoy was armed

Sadly disappointing for the police to hold back this information. Maybe to please the
gun grabbers though means of bias towards lawful gun owners since this criminal
was not legally allowed to own a firearm due to his criminal history.

See, criminals don't own guns because it's illegal.

“Branum said there were “seven or eight” employees inside the building at the time of the incident but no customers were present.

Police would not say if McCoy was armed, and no additional details about the robbery attempt were disclosed Monday. Branum did confirm there is surveillance video of the incident.

“We are gathering information, and ultimately, we will have to meet with the prosecutor’s office so they can make a decision on whether or not charges will be filed,” Branum said.

The Richmond law firm of Moore Kemp released a statement on Padgett’s behalf Monday that said, “We have confidence in the investigative process and Mr. Padgett will continue to cooperate with the detectives. Mr. Padgett acted quickly and decisively to protect both his business and his daughter.

“Mr. Padgett and his family are still recovering from this tragedy but are expected to resume business Thursday. Mr. Padgett, his family and employees are grateful for the support they have received in this difficult time. Our thoughts and prayers extend to the family of Mr. McCoy, his friends and loved ones.”...”

For what it’s worth...
(from the same link I provided above)

Was the shooting legal?

This is part of Indiana Code 35-41-3-2 which deals with the use of force to protect person or property (sections relating to airplane hijacking and incidents involving public servants have been removed). The complete code can be found at:
www.in.gov/legislative/ic/code/title35/ar41/ch3.html

Sec. 2.
(a) In enacting this section, the general assembly finds and declares that it is the policy of this state to recognize the unique character of a citizen’s home and to ensure that a citizen feels secure in his or her own home against unlawful intrusion by another individual or a public servant. By reaffirming the long standing right of a citizen to protect his or her home against unlawful intrusion, however, the general assembly does not intend to diminish in any way the other robust self defense rights that citizens of this state have always enjoyed.

Accordingly, the general assembly also finds and declares that it is the policy of this state that people have a right to defend themselves and third parties from physical harm and crime. The purpose of this section is to provide the citizens of this state with a lawful means of carrying out this policy.

(c) A person is justified in using reasonable force against any other person to protect the person or a third person from what the person reasonably believes to be the imminent use of unlawful force. However, a person:

(1) is justified in using deadly force; and

(2) does not have a duty to retreat;
if the person reasonably believes that that force is necessary to prevent serious bodily injury to the person or a third person or the commission of a forcible felony. No person in this state shall be placed in legal jeopardy of any kind whatsoever for protecting the person or a third person by reasonable means necessary.

(d) A person:

(1) is justified in using reasonable force, including deadly force, against any other person; and

(2) does not have a duty to retreat;
if the person reasonably believes that the force is necessary to prevent or terminate the other person’s unlawful entry of or attack on the person’s dwelling, curtilage, or occupied motor vehicle.

(e) With respect to property other than a dwelling, curtilage, or an occupied motor vehicle, a person is justified in using reasonable force against any other person if the person reasonably believes that the force is necessary to immediately prevent or terminate the other person’s trespass on or criminal interference with property lawfully in the person’s possession, lawfully in possession of a member of the person’s immediate family, or belonging to a person whose property the person has authority to protect. However, a person:

(1) is justified in using deadly force; and

(2) does not have a duty to retreat;
only if that force is justified under subsection (c).
(g) Notwithstanding subsections (c) through (e), a person is not justified in using force if:

(1) the person is committing or is escaping after the commission of a crime;

As a kid I started camping at a place called Devils Lake, in Wisconsin. The bluffs are about 600 ft tall and where I first started climbing.

Not me climbing. Just a pic I found online.

Actually, Devils Lake is a popular spot for people to practice before heading out west for serious climbing.

As a kid I fell in love with Devils Lake and the outdoors and dreamt of what the mountains would be like with a high mountain lake. I never made it to the Rocky Mountains until I was an adult (physically not mentally). I was 26 when a buddy taught me to ski (at a place about 15 minutes from Devils Lake) and made my first trip to the Rockies the following year, to go skiing. Finally found my first mountain lake about a half dozen years later.

Actually, I live 26 miles from downtown Chicago. I try to make it out west a couple of times a year.

My goal is to retire out west, preferably in or around Estes Park, Co. Population 5800, Elevation 7522

At the bottom of the picture you'll see Lake Estes and the town of Estes Park. The Mountains in the background are to the west, in Rocky Mountain National Park. The town is at 7522 feet. The snow line is at approximately 12,500 feet. Longs peak, the highest point in RMNP is 14,259 feet.
