Delay Election Day? Hell No.(Attention Eeyores)

As usual, I’m with Mark Steyn. All of this chatter about delaying election day is ridiculous on every level. First, it’s not going to happen. Despite the chatter, the president has no authority to change election day. None. Zip. Nada. Those people who simply assume this is a presidential decision are betraying the degree to which they simply accept the legitimacy of an imperial presidency. Now I understand limitations on presidential power haven’t always curtailed this president. But if he tried to move or delay election day it would be a national scandal and outrage (or at least it should be). The power to set the election day lies with the states. You’d have to change a vast patchwork of state laws (all the Constitution requires is that the states deliver their electors in mid-December). Also, Congress has a role to play because it determines, by statute, the timing of elections.

All we’ve been hearing about for the past two months has been “early voting” and “absentee voting”. There is no reason to drag this fiasco out any more than we already have.

Everyone knew the storm was coming and had plenty of time, if they chose, to vote. No one was denied their right. Some may have simply chosen not to use it.

Only the coastal areas were hit, and most people are getting around OK today. The election is a week away yet.
There's no reason to delay an entire election because of the few who chose, by their own free will, to wait.

I believe this propaganda is a trial balloon. Pop it - right now, before it gets any bigger.

I believe the Constitution is specific on the voting date.

If that happens, as some citizens expect of "dear leader", about ten million armed people will take to the streets. He is at heart a socialist dictator in presidential clothing waiting for the opportunity....as are we.

First... Since when has Barry cared about what the Constitution or it’s limits on Presidential powers...Second when has Congress stood up to King Big Ears and his over-reach of Gov’t power? Annwer: NEVER! If Obama wants to delay the election he will..the MSM will sheild the President as usual and the Republican “Leadership” will piss and moan but as usual do nothing!

National elections are held on the first Tues, after the first Mon in Nov, on even numbered years.

They can't be changed due to weather or any such silly reason.

Right now people in the NE are still in shock. Anger will not kick in until the shock wears off, and then will intensify with each passing week. If the election is delayed at all, it will only hurt obama. If obama were smart he will stop all campaigning in order to appear to be in charge, and then do everything he can to get the election in on time in the NE.

Thinking this...what does O have to gain by delaying the election?

The two states most affected by Sandy are NJ and NY - both strongly in the bag for him even if half their residents couldn’t vote.

Hell he’s in trying to save some type of legacy right now...

Make it seem like you’re competent in handling Sandy and then blame your loss on the upheaval caused to your voters because of it.

He can walk off into the sunset with the shoulda, coulda, woulda excuse.

3 USC § 1 - Time of appointing electors: The electors of President and Vice President shall be appointed, in each State, on the Tuesday next after the first Monday in November, in every fourth year succeeding every election of a President and Vice President.

Congress set the Election Day in the US Code. This day could be changed through an act of Congress. There is no chance that Congress could get their act together to do this when they are busily running for reelection so that they can fleece the next generation of Americans, not when voters might be offended at their overreach and punish them at the polls. If Obama tried to move the date through a "state of emergency" declaration, even liberals know that the backlash would be ugly.

You are absolutely right. The only way to change election day is by a Constitutional Ammendment.

No reason to delay, but you’re wrong about people having had their chance to vote. E.g., in CT no early voting and by law ansentee if you would have been out of state or otherwise (not weather related) incapacitated on election day.

Both are wrong. The Constitution does not specify the date of an election.

Current election date is specified by US Code, not the Constitution, as the first Tuesday after the first Monday in November. This was established in 1845 to standardize the election date amongst the states. It is possible to change this date by Act of Congress, it does not require an Amendment.
