Hurricane Sandy: Could it push back the election?

The Federal Emergency Management Agency is preparing for Hurricane Sandy to disrupt next week’s elections, agency Administrator Craig Fugate said Monday afternoon.

“We are anticipating that, based on the storm, there could be impacts that would linger into next week and have impacts on the federal election,” Fugate said on a conference call with reporters.

But any potential tinkering with Election Day would bring a bevy of legal issues.

“Our chief counsel’s been working on making sure that we have the proper guidance,” he added. “We’re going through the regulatory policy and making sure all that’s in place and we can support it.”

Fugate did not address whether the election could be delayed — a question that federal officials said last week is up for states to decide.

However, the report theorizes that presidential emergency power could be used to delay an election — specifically, if “attacks, disruptions and destruction are so severe and so dangerous in certain localities, particularly in crowded urban areas, that the President under a rule of necessity may look to protect the public safety by federalizing State national guard and restricting movement and activities in such areas which would obviously affect the ability to conduct an election at those sites.”

Congress could also theoretically step in and pass a law or give that power to the president, the report says. Courts have typically left it up to Congress to set election procedures.

Minor little problem. Article 1. Section 4 of the Constitution:

The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Place of Chusing Senators.

He has no authority to cancel elections under presidential emergency powers.

If he tries it, all the red states vote in Romney as per the law, and then we have two presidents.

Next step is a meeting with the military to remove the Kenyan communist and his gang of perfumed princes at the joint chiefs.

Well, f*** the report. The Constitution says: "The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators."

The Constitution also says: "Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors..."

There is no "Presidential election". There are 50 separate processes under the direction of 50 separate State legislatures, and neither Congress not the President (by design, I might add) has anything to do with it, except that Congress may specify a deadline by which Electors must be chosen, and must specify a single date on which all the Electors vote.

This is just a trial balloon. I’ve seen several already. Depending on reaction, they will push this further or drop it. The Admin would love to push this as it will muddy the waters and make a mess of the elections. Throw them into the courts. I wouldn’t trust SCOTUS on this one.

This is hurricane season...like it is EVERY SINGLE YEAR. Can anyone, with a straight face, say that a hurricane has NEVER caused a lot of damage the week before/week of a November election? NO! Florida deals with this all the time, and I’ll bet that literally millions haven’t voted over the last 150 years because of this - and so what!

Cheating with The Voting Dead and hundreds of thousands of illegals is bad enough (and treason, I might add), but changing Election Day has NEVER occurred before. NO WAY!

All the more reason to get on the phone and call EVERY elected representative you have. Let them know we WILL NOT tolerate talk or action for this. Call the White Hut, too.

If obummer did this, it would backfire big time against him. Most states affected are in the demo camp already. NC, VA, PA, OH could go heavily against the dems out of disgust
