As was noted on AT recently, a retired State Department Foreign Service Officer said: "Our Benghazi facility was a half-baked operation. It was not a consulate. It was a 'facility' with an ambiguous purpose, at least as far as the unclassified world is concerned."
If it was not a consulate, then it was not sovereign United States territory. This fact has important legal consequences -- as was only just touched upon (at ~13:00, but pick up at ~10:00 for full context) by Newt Gingrich on Fox News in his appearance on Greta Van Susteren's Oct. 30 show (caution: auto-play).
One of these consequences may be that the United States had no "legal" authority under international law unilaterally to violate sovereign Libyan airspace by sending in a military force or by engaging attackers with U.S. aircraft, irrespective of the fact that U.S. citizens, including an ambassador, were the ones being attacked.
The purpose of this "facility" and its associated "safe-house" is increasingly becoming less ambiguous, as J.D. Longstreet points out:
That CIA "safe-house" has troubled me from the very beginning. ... What was the CIA doing there? There was no embassy in Benghazi. In fact, the building attacked was not even a consulate. If anything, it was a "mission" ... this was NOT an embassy.
It no longer reasonably can be denied that what was going on in Benghazi was "Fast and Furious in the Maghreb" being run by Ambassador Stevens, et al. at the direction of "fill in the blank."

It is high time the media started with the facts. The fact is that this was a CIA operation from start to finish.
So did Somalia give approval for Team 6 to extract two hostages at the beginning of the year? Obama was telling Panetta good job for that extraction while on camera during the State of the Union.
I can’t get over the impression that someone was intended to die at that facility. A Gay Hero who would be useful for The Disaster’s campaign.
An American CIC would have gone in and worried about feelings later.
But how would they make that case for the personnel? I presume that ambassador Stevens and all the rest were there with the knowledge and permission of the provisional gov of Libya. Wouldn't we have the 'right under international law' to defend officials of the U.S. gov who were present in the country with Libyan approval?
Then the Brits, Italians, French, USA, Qatar, other’s equally violated Libyan air space during the NATO operations last year. The Russians and Chinese did not give the thumbs up, within the five permanent members of the Security Council.
We were trained to jump from commercial airliners because they are ubiquitous and nonattributable. It is one thing to prohibit American military aircraft from flying over your country. It is quite another to close down your airspace to all commercial traffic. Libya, Syria, Cuba, and a host of other thug nations allow commercial flights to fly through their airspace. This is all the opening a SEAL Team needs. Unknown and unseen, a SEAL element can parachute into any place on earth. One might insert: that is, provided one survives the jump. The trick is to exit in correct body position and deploy your parachute after the appropriate delay. There are two principal types of SEAL parachute operations: HALO, or high altitude, low opening; and HAHO, high altitude, high opening.
I am drawing a blank here....the Blackhawk down incident?
Pirates kidnapped civilians. They were held hostage about three months. Team Seal extracted suddenly when mysterious information was revealed that a medical condition was about to end her life. Oh, just as Obama was going to do the State of the Union.
If a member of your family was being murdered in the house next door would go to a judge for a warrant to enter the house?
REMEMBER OBAMA and his crowd are Globalists at heart and will always strive to work under some legalistic cover.....
The most useful is R2P ---Acronym as Responsibility to Protect---
There is a large PSF document on that !!!
Syria with all of the Civilian casualities would likely be construed to be under that....
Now would Gun Running to the Rebels be covered....
I think there are some UN resolutions on Syria.....
Either that or his loss was deemed acceptable; after all, if he’s dead he can’t spill the beans.
The current crowd in Washington would do just that.
And the ambassador’s three black security officers.
