Few rape kits tested in Colorado; Police say it's not necessary, victims think otherwise

Colorado police departments are collecting hundreds of rape kits, but a CALL7 Investigation found many of those are not tested. And experts and victims tell us that is a problem because those kits may allow police to identify serial rapists by putting any DNA into a national database.

Kelly Binder says she was drugged and raped two years ago by a man she met at a bar in downtown Denver. She is upset police didn't test her rape kit because she is concerned her attacker could still be raping other people.

Binder feels like she's been victimized twice -- once by her attacker, and again by the system that was supposed to protect her.

"The fact that my rape kit test, was never submitted into the system, just allows another predator to go free, to do this again to somebody else," Binder said.

None of the departments interviewed for this story could say how many total rape kits were being held in storage, or how many total had been tested.

CALL7 Investigators found several states and large cities have laws that require all rape kits to be tested and the U.S. Department of Justice is working on rules that will direct jurisdictions on the best practices for testing those rape kits.

Let’s try this again in English. It’s a vote for law enforcement managing their financial budgets to include rape kit analysis. This isn’t raising taxes... it is using the same amount of money fiscally responsibly. Instead of buying brand new, shiny police cars... keep the older cars maintained and spend the money on analysis. Instead of buying a tank, increasing their SWAT units, etc... it is spending the same money on analysis. The budget remains the same but gee... maybe they can catch a bad guy once in a while. Sheesh... what is with you? Every woman or girl that is raped is a drunken slut asking for it?

In other words, avoid the situations where you get date-raped, and things will go better.

So, another blame the victim idea.

If all single women in CO started boycotting bars, don't you think the rapists would start going to where the women are? Date rape drugs work when dropped into coffee at Starbucks, just as well as when dropped into booze at the bar.

Are you arguing that the women should only go about when accompanied by a male relative to protect them?

And even that doesn't work, as predators learn how to separate the target from the group. It was killing all the wolves that made hiking in the woods while unarmed a reasonable thing to do.

The problem is the predators, not the life of the prey. If you leave the predators alone to increase in numbers, there's no way to make the life of the prey completely safe.

The problem is not the bar. The problem is the rapist—who may be anywhere you are.

Add this provision to existing law: if the rape kit is not processed within 10 business days, the victim is paid, say $1000 from the lazy government employee’s salary for the purpose of buying a personal firearm for protection.

Government employees aren’t doing their jobs because they lack incentive to do so.

I wonder what percentage of the untasted rape kits contain evidence that would incriminate one or more of said government employees.

Yep. The SWAT team’s budget, new police cars, armored vehicles, drones....

Shiny toys are more important than catching dangerous criminals, don’tcha know.

Your rationalization for bigger government can be any thing for any problem.

The choice, however, is simple:

- Raise taxes to pay for rape kits.
or
- Don’t hang out in bars.
