Yes they can prosecute former military- retired or other separation designations if it is determined that the violations occurred while still on active duty. The military can and has yanked people back in to face prosecution. It is not common and I seriously doubt it would happen here but it is absolutely possible.
If the crime occurred while he was on active duty, he could be subject to recall and UCMJ prosecution. To prove adultery, you need a very high burden of proof (something on par with a notarized sex tape with three witnesses for adultery), and a willing prosecutor. Once that burden is met however, the charges get piled on (conduct unbecoming of a commissioned officer, failure to obey an order not to get it on while deployed, poor command climate, etc...)
By this point, Patraeus has certainly gotten the council of legal experts, and having his depth and breadth of experience in the legally careful world of the general officer corps, he’s not going to do anything accidentally to make the case against him any stronger.

No offense, but I think you’re wrong.
I believe that the specificity of Petraeus’ resignation statement last week was a declaration of independence from the blackmail the O thugs were using to keep him in line.
He could have easily resigned “for personal reasons” or “to spend more time with his family” or some other generic reason. Why admit to adultery, thus exposing his wife and children to ridicule, unless he’s specifically removing the blackmail ammo they were using to keep him quiet?

Well it USED to be Article 125. They did away with it. I can’t imagine how many times it was used anyway. Basically having sodomy with your wife could land you in jail...
I assume it would usually be for serious violations, like theft or security issues.
Never trust an officer who stays on active duty to work for a liberal president. NEVER. Patriotism has nothing to do with it. It’s an ego trip. Any one with a sense of decency will be no part of a presidential administration that is hostile to the military and wants to cut the force. Never forget the worthless Robert Gates, who was Bush’s second Sec of Defense.
Flags should have went up with this character when he decided to stay on as Obama’s Sec of Defense. He showed his true liberal colors when he was the main driving force in allowing sodomites in the US military. He advocated for lifting DADT. Bush was a RINO, who appointed as many liberals as he did conservatives. The absolute worst being the worthless John Roberts, with a close second Robert Gates.

The point remains. By admitting adultery, he removed the leverage others may have been holding over him.
Unless, of course, there’s more we don’t yet know.
I seriously doubt that. He may have been an adulterer but he has served his country with honor and will likely continue to comply with every request made of him by the U.S. and Congress.......

The chances of the military charging Petraeus with adultery after he has left service are worse than slim to none. Even in the case of adultery while still in service, it is extremely difficult to prove absent pictures or personal confession.
IIRC, Petraeus has put no timeline on his alleged adultery. Additionally, it is also impossible, if he recanted his confession, to prove beyond his own word. He didn’t confess under oath, and he could always say there were politically expedient, personal, psychological, etc., reasons that he said what he said and then recant his confession.
The military is not going to charge him. He did this purely to help Obama with the Benghazi case.
For the FBI to say they found out about “adultery” would require them to prove penetration. I’m betting they can’t do that, and that the military wouldn’t pursue such a thing without rock solid proof.
