Frivolous Lawsuits Shut Down Largest Gas Can Co. as Sandy Spurs Demand

The nation’s largest gas can manufacturer has closed its doors due to frivolous lawsuits at a time when Hurricane Sandy victims urgently need the containers.

The company's closure has resulted in a shortage of gas cans for purchase or use in the disaster areas of the northeast, and in the US as a whole.

The company, Blitz U.S.A., is a 50-year-old American business that has closed its doors and laid off all 117 employees. Blitz U.S.A. provided 75% of all gas canisters to the US, a feat which industry insiders say is only possible when a company does everything right.

A swarm of lawsuits hit the company since last March, mostly due to injuries from individuals pouring gas directly onto a lit fire. All but two were thrown out of court for frivolity. Unfortunately, the successful outcomes for the company in the courts did not stop insurance rates from increasing to fiscally unbearable rates.

The company’s closure and the resulting lack of gas canisters could not come at a worse time for victims of Hurricane Sandy in the American Northeast.

Go to your nearest dirtbike dealer and buy their good 5 gallon plastic gas cans with the removable spout hose and normal vent. Easily the best solution.

I'd like to get my hands around their scrawny little necks along with the Tylenol killers who forced everything to be shrink-wrapped and sealed. Oh, and the inventor of those stiff plastic blister-packs that slice your flesh open when you try to remove the product inside.

There was a period a few years ago when you couldn't find a gas can that didn't have an annoying yellow device on the end of the spout. I think it was supposed to reduce pollution from gas vapors but it didn't work right and just made the cans had to use.

All these cans were made by the same company and it was clear that rather than doing everything right, they may have had a hand in passing the law that required the spouts. I don;t remember for certain if this was Blitz, but if so, maybe it is better that they left the scene.

You can thank California for those self sealing, non vented gas can spouts. C.A.R.B. approved cans are the only ones available for sale now, This is why the excellent Sceptor USGI cans can not be sold in the US as well.

They made the best Gas Containers until the Federal Government mandated those so called no spill things. Now you can’t get the gas to go where you want it to go while trying to get the nozzle to open up. Gas gets spilled all over, and takes 10 minutes to empty one container because they have no vent. On top of that the plastic nozzles crack break and fall apart leaving a container that you can’t possibly poor anything thing out of without half of it going all over...

If you have any old ones then hang onto them. They are worth their weight in Gold.

This is one thing I saw coming and I bought up lots of them for my personal use. Have a lifetime supply.

takes 10 minutes to empty one container because they have no vent.

I haven't seen the ventless cans but couldn't you just punch a hole in the top and make your own vent?

There’s a similar can being sold here made by Scepter, a Canadian company. They are so bad, they actually make the Blitz look like a quality product. Stay away from them.

Now ain’t that just ducky! Now, people will have to carry gasoline around in plastic water bottles, with the resulting fire and poisoning hazards as well as an increase in air pollution.

No, now the only gas cans available will be the ones made in China, where the manufacturers are effectively judgement-proof from frivolous lawsuits from the US. This is one major reason why so much manufacturing has gone overseas.

I would not be surprised if a Chinese gas-can manufacturer was behind these lawsuits.

The plaintiff should be required to pay defendants legal costs if the defendant wins in court. I believe UK and other countries follow this rule.

No, because the plaintiff will generally have no assets and his lawyer will be on commission.

Have the plaintiff's LAWYER be required to pay the legal fees, with his license getting suspended if he doesn't pay within 30 days.

I have no problem with that. The way it is now, the plaintiff’s lawyers have nothing to lose by suing anybody. If they can fool an uninformed and unqualified jury, they hit the jackpot. My company had a permanent legal staff just to defend suits which involved highly technical issues. Neither the judge or the jury was qualified to rule correctly.

Just one example...the users disconnected safety devices, then got hurt losing fingers or even a hand. The jury ignored the cause of accident, and only saw the poor operator as a victim with no hand.

We have 10 times the lawyers/person compared to Japan, and probably much more compared to China.
