Call volume shuts down FBI’s firearm background checks, stops Maine sales on Black Friday

By Nok-Noi Ricker, BDN Staff Posted Nov. 23, 2012, at 4:30 p.m.

BREWER, Maine — Sometime early on Black Friday, the FBI’s National Instant Criminal Background Check System, or NICS, went down and stopped all gun sales, Bangor-area gun dealers said.

High call volumes caused “intermittent outages” in the system, an FBI spokesman confirmed Friday afternoon.

“It means we can’t sell no damn guns,” Rick Lozier, a manager at Van Raymond Outfitters in Brewer, said at about 1:15 p.m.

“NICS is down, which means nobody is selling guns right now, on Black Friday,” said Ralph McLeod, owner of Buyers Guns in Holden.

Those who want to purchase a gun in the U.S. must fill out and sign FBI paperwork. The gun dealer then calls NICS to see if the buyer is barred by federal law from possessing firearms.

“The message is they are going to be down for a few hours,” McLeod said at about noon Friday.

Black Friday sales played a role in the problems with NICS, the director of the FBI’s Criminal Justice Information Services Division said, responding to an email from the Bangor Daily News.

“The NICS has experienced intermittent outages today due to high call volumes,” Stephen G. Fischer Jr. said at about 2:15 p.m.

Lozier, who has worked at Van Raymond’s for more than a decade, said the outages cost him at least half a dozen customers by the time the business day was only half over.

Meanwhile, hits for the acronym-challenged NCIS searchers are UP.

There were at least 50 people waiting outside Hoffman's in Newington CT last Friday morning to purchase at least one (or both) of the hand guns on sale: a Taurus PT380 for $169 or a Walther PP22 for $229. They were very efficient in processing the sales.

I thought it was the case that if NICS didn’t return a negative within a certain amount of time, it was a default approval...

Good. Take note, Mr. Obama. You cannot defeat us all.

Gander Mountain in Raleigh NC shut down as well. Don’t know about the rest of the state.

And remember, the government is now handling our private — and potentially critical — health care information.

They may win the fight but my base goal is to make sure they never remember the fight fondly.

Good but if you haven’t already armed up in response to the diseased jackass’ first term, you better hurry. The idea is, you have to have so many guns you’re unsure how many you have. You should have more ammo than you can lift even in three trips. It’s that bad and you may need to share once the fighting starts.

I believe you are correct. However, it was also my understanding that BATF has informed all the gun dealers to not even think about that.

Ah, the lawless government.

Such innocuous laws, see? If the system doesn’t respond, the default is to allow you. Why would you oppose this system?
And then behind the scenes, govothugs say you better not make us comply with YOUR law, or we will punish you.

Yes, the grip on the P22, and Ruger’s SR22, are also very nice - just the right size for a .22LR semi-auto.

“I thought it was the case that if NICS didn’t return a negative within a certain amount of time, it was a default approval...”

In Colorado, that’s true. We do ours through the CBI Instacheck system that in turn automatically accesses NCIS. In Colorado, if they can’t respond with a denial within 72 hours, they HAVE to issue an approval.

Except where state laws may be stricter, I think it’s federal law that the approval goes through if a denial is not issued within 72 hours; however, I’ve also read that the FBI may continue it’s research and if they eventually get a reason for denial, law enforcement may make a personal visit to a buyer’s home to retrieve the purchase.
