Judge removed in Fort Hood shooting rampage case

FORT HOOD, Texas (AP) - The military's highest court ousted the judge in the Fort Hood shooting case Monday and threw out his order to have the suspect's beard forcibly shaved before his court-martial.

The U.S. Court of Appeals for the Armed Forces ruled that Col. Gregory Gross didn't appear impartial while presiding over the case of Maj. Nidal Hasan, who faces the death penalty if convicted in the 2009 shootings on the Texas Army post that killed 13 people and wounded more than two dozen others.

The central socialist/communist government has ruled this a workplace violence crime.

IT WAS NOT! Rather it was an act of terror which has resulted in the muslim terrorist being mollycoddled and allowed to do whatever he wants. His years in prison will be put to good use by his recruiting other nuts to kill more of us!

Why we warehouse murders for decades at an enormous cost rather than hanging, shooting or electrocuting them is yet another indication of a sick society that exaults homosexuals, lesbians and other things, but treats Christian and Jewish citizens like we're the ones who are abnormal!

How many more cases of adult diapers will the taxpayers have to buy before this murderer is finally brought to justice? For the life of me I can’t understand why they didn’t finish him off when they had the chance.

The members of the US Court of Appeals for the Armed Forces are civilians, appointed by the President for 15 year terms. There is currently one vacancy on the 5 member court. Three of the members of the Court were appointed by George W. Bush. The current Chief Judge of the Court was appointed by William Jefferson Clinton.

Here we have 4 civilian judges ruling the military cannot force a prisoner to shave even though the prisoner voluntarily joined the military, was aware the Army did not permit facial hair when he joined, and served up to the time of his crime in compliance with the facial hair regulations. It has only been subsequent to his crime that he demanded special privileges on religious grounds.

The fact this court would remove a military judge for insisting a soldier under trial comply with military regulations is a travesty of justice. The face three of the four judges were appointed by George Bush demonstrates how little the Bush White House really cared about conservative values and principles. Had these judges been properly vetted the court would have rejected Major Hasan’s appeal and ordered him shaved.

No doubt Obama will appoint an Elizabeth Warren or Elena Kagan liberal to the vacant seat.

I'm with you on that, and praying for an end to the death penalty isn't my cup of tea.

IF he has yet to be discharged, he still must conform to uniform protocol and SHAVE HIS DARN FACE as per regs.

Are we at the point where anyone facing Courts Martial could declare a religious eccentricity or maybe a strong adherence to nudity and demand to appear in that fashion, thus delaying their trial indefinitely?

This has never been anything but a clear cut case. Hasan should have been tried, convicted and hung long ago.

Political considerations are now more important than justice.

It wasn't just terrorism. It was also clear, black letter law, treason. Article III, Section 3 of the Constitution defines treason and the Govenment's burden of proof in treason cases as follows:

Treason against the United States shall consist only in levying War against them, or adhering to their Enemies, giving them Aid and Comfort. No person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt act, or on Confession in open Court.

There's no real issue of Hassan's motive: all of his statements and writings show he murdered those people as an act of Jihad (war) against the United States and that he did it explicitly and deliberately to further the cause of our Islamist enemies. There are multiple witnesses to the murders, with Hassan screaming "Allah Aukbar" while committing them, and to his repeated earlier statements of bitter hostility ot the United States and sympathy with out Islamist enemies. Hence, a treason prosecution, adhering to the strictest constitutional standards, would be a slam dunk. Obama, by not doing such a prosecution, is himslef giving aid and comfort to the enemy and committing treason.

Any other action tells soldiers that the regs are worthless and optional.

and even if he refuses to comply, because, hey, what are they gonna do, court-marshall him? ... I believe it is well within the judge’s right to request it. He should never have been removed.
