Lawyer for George Zimmerman 'frustrated' at prosecutors' withholding of graphic photo
Fox News ^ | December 4, 2012 | Perry Chiaramonte

The attorney for George Zimmerman said he is "frustrated" that prosecutors withheld a color photo of the Florida gunman that could bolster his case that Zimmerman was being beaten when he shot Trayvon Martin.

The graphic photo of Zimmerman, taken the night of his fateful confrontation with Florida teen Trayvon Martin, shows the accused murderer with a bloody face. Zimmerman’s legal team released the photo, which was taken by police, after prosecutors substituted it in for a black and white photocopy that had been submitted earlier.

"I get frustrated when certain evidence gets out and other evidence is withheld," said Mark O'Mara, attorney for Zimmerman, 29, who faces murder charges in the Feb. 26 death of Martin, 17. "The photo is not a game-changer, but it is significant.

"If I had had that picture in my hand on April 11 ...," he said, referring to the date when Zimmerman was charged with second-degree murder.

Florida rules governing discovery require that original photos be submitted, but O'Mara says that the discovery phase has been rife with issues.

"It just seems like it's been pulling teeth for discovery in this case," he said. "This case is the opposite of any I've normally taken. Usually, discovery is dumped on your desk, because it's normally good for [the prosecution]. They usually try to shove it down your throat."

Listen to the interview as the clueless blond attorney spins for the prosecutor's office, and gets nailed on it.

Marcia Clark said that as long as she didn't give it to the Defense when the trial started then they are ok. I guess the Prosecutor can take as long as they want to release this type of evidence. She said there is plenty of time before the trial and this should not be an issue. I guess that is why the Defense is only “frustrated” since he can't do much more than be pissed.

Disclosure of Brandy material is a fundamental right of criminal defendants. If these prosecutors keep screwing around they will blow their case. Not that that would be so bad . . . .

Zimmerman is a victim of a Government frame up.

Done because that State was frightened by black mobs and race baiters.

In effect they only put off the riots, as when Zimmerman is found not guilty they will still have to face the black mobs.

Nothing like political, selective prosecution.

The gov't has deep pockets. Check with the dude that made the near parody of the Life of Mo-Ham-Mad.

Does anyone remember how long they were engaged in the struggle before the shot, because it looks like it was pretty intense for the man claiming to have been attacked.

When I look at these pictures, my first impression is that he was lucky that he made it to his gun, before it was too late.

"It just seems like it's been pulling teeth for discovery in this case," he said.

Sort of like the Benghazi case, isn't it?

It’s beginning to look a lot like Nifong.

Duke LaCrosse Redux.

Somebody needs to be disbarred.

Where are the sanctions for prosecutorial misconduct? Is the judge in the tank too?

Fired, dis-barred and imprisoned... Prosecutors, judges, police, attorneys, media, politicians, race baiters of every stripe, and anyone else who was involved in this attempt to frame what is clearly an innocent man. It’s been an abortion of American justice — that is, Justice with a capital ‘J’ — and anyone who is guilty of it is as good as a traitor, a hater of America and its people, and should be in jail the rest of his miserable life.

“Marcia Clark said that as long as she didn’t give it to the Defense when the trial started then they are ok.”

Marsha Clark is lying. Disclosure is mandatory, and a case will surely be made that the Persecutors(not a typo) in this case deliberately perpetrated a fraud on the Court.

This case was a race based lynching of Zimmerman, conducted with the connivance of the State of FloriDUH State Attorney’s Office and the Scheme Team representing the Martins. Bet on the Obama Justice department being involved as well.

However, only of documents are leaked will the dirty deeds be outed and justice be meted out to the cast of miscreants.

The media too. They describe Zimmerman as a “gunman”. Usually a gunman is someone who shoots people while committing a crime.

<>Is the judge in the tank too?<>

We’ll find out at the hearing next Tuesday when she rules on these motions that document the prosecution’s stonewalling of Brady material.

At the first hearing she was deliberately obtuse regarding the tape of Crump’s March 19th interview claiming that he will bring the recording device to his deposition — yeh, right!!!!
