This is one of the problems.

If the burglar had started running when he got outside and the Homeowner had shot him to keep him from running, the homeowner would have been guilty.

This guy was obviously not thinking or he could have run.

Anyone you are holding for the police who is not attacking you, but running, you are helpless to stop.

You are assuming that the burglar believes that the homeowner fears the law. The burglar does not, so he projects that the homeowner does not. Thus, he fears the homeowner more than the law. He does *not* know the homeowner will not shoot, and seen from stories that I have posted on freerepublic, he is right to be fearful about it.
