A shoplifter who was chased down and shot in the face after swiping a bottle of vodka from a Colorado Springs liquor store is suing the shop owner.
Bryson Adrian Dewberry is seeking at least $100,000 for pain and suffering two years after he was wounded in the jaw by a bullet fired by Chang Ho Yi, the owner of Austin Bluffs Plaza Liquor, 4150 Austin Bluffs Parkway. According to a lawsuit filed in early October, Yi witnessed the theft on Oct. 25, 2010, and pursued Dewberry out of his store with a loaded .357 revolver, which fired as Dewberry was in the backseat of a getaway car.

Dewberrys lawsuit alleges that Yi behaved negligently and recklessly in brandishing a gun at a shoplifter who posed no physical threat. Colorado law permits residents to use deadly force in self-defense, but offers no such protections in defense of property. Yi and his company, Yi Enterprises Inc., are the sole defendants.
Although Yi was initially arrested on suspicion of attempted murder, the El Paso County District Attorneys Office sent the case to a grand jury, which declined to charge Yi.

I saw a movie once where some asshat broke in line at checkout and got into a fracas with the grocery store security guard over the jumping. Long story short, the guard shot him. As he was lying on the floor when the police and paramedics arrived. He was smiling and laughing. The cop, I think, asked him why he was in such a good mood, being shot and all.

This means only one thing. The shop owner should have aimed a little lower. Or followed up with a clean kill shot.
But then... The shoplifter’s SURVIVOR’s would have been suing.
Ah well. Can’t win some days.

He should sue the gun, according to this the gun did it.
While not advocating death for shoplifting, if the shop owner had been a better shot, there would only be family left to sue.

Yes, that’s true! Isn’t it interesting though that when one of “Holder’s People” is the perpetrator of a crime, the press seldom publishes his picture (unless he winds up dead).

I live near Colorado Springs. Any jury is a crap shoot, but if I were a wagering man, I'd put a nickel on the liquor store owner. If I were a drinking man, I'd go out of my way to patronize the place.
The thought crossed my mind but the store is near a church I attend LOL. I know there is another liquor store owned by Koreans by the Fazollis and Korean Restaurant on Austin Bluffs.
IMHO, the guy getting shot should serve as an example on not stealing.

I want to know why the admitted shoplifter wasn’t charged with shoplifting. Great cops they have there in C-Springs
