(CNN) -- President Obama's poignant speech at Sunday's interfaith vigil in Newtown, Connecticut, set the tone for our mourning. Now, America's path forward will be decided out of the spotlight. The question of whether the tragedy at Sandy Hook Elementary School will linger only in memory or be memorialized by an enduring shift in gun policy can only be answered by the legislature.
Incoming Judiciary Committee chair Sen. Diane Feinstein has announced she will introduce an enhanced assault weapons ban on the first day of the new Congress, but the fate of that legislation is in the hands of Vice President Joe Biden.

What I want to know is how you ban the "transfer" of something that is not registered in the first place, is it on the honor system?!? I understand you can ban the transfer of an automobile, because it has to be titled. But most of my guns were purchased from individual, cash transaction, no paperwork. Who's to say they were purchased before or after the ban on "transfers" and who could prove if I sold it after the ban when the transaction occured?

You left off the most important part of the proposed legislation - POSSESSION. Possessing one - if caught - will put you on Big Sis's terrorist watch list. Good luck with that
It's my understanding that just like the 1994 ban "possession" means possession of an assault weapon obtained by one of the prohibited means "transfer" "sale" etc after the date of the ban. All existing assault weapons in private hands would be grandfathered in. I don't think even Feinstein and Obama are stupid enough to try and confiscate 25 million assault weapons in private hands (not that they wouldn't like too, but because it would make the feds looks just as ineffective and impotent as they do with the "war on drugs" and people might get the idea to ignore other laws)
